It replaced the Consumer Protection Act 1986 to address emerging challenges such as misleading advertisements, e-commerce transactions, unfair trade practices and product liability. The Act came into force on 20 July 2020 and aims to empower consumers by ensuring access to justice that is affordable, speedy and technology driven. It reflects India\u2019s commitment to consumer welfare in a rapidly evolving market economy.<\/span><\/p>\n<h2><b>Consumer Protection Act 2019<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Consumer Protection Act 2019 was enacted after recognising the limitations of the 1986 Act in handling modern consumer disputes. Earlier, consumers relied on a three tier redressal system that often became time consuming due to jurisdictional and procedural delays. With expanding markets, digital platforms and aggressive marketing practices, consumers became more vulnerable to exploitation. The 2019 Act introduced institutional reforms, stricter penalties and new mechanisms like mediation and product liability to protect consumers. The major provisions laid through this act has been listed below:<\/span><\/p>\n<h3><b>Definition of Consumer<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Under Section 2 of the act, consumers along with other terminologies have been defined. A consumer is defined as a person who buys goods or avails services for consideration. It excludes purchases made for resale or commercial purposes. The Act covers all transaction modes including offline, online, electronic platforms, teleshopping, multi level marketing and direct selling.<\/span><\/p>\n<h3><b>Consumer Rights<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act legally recognises key consumer rights:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Protection against hazardous goods and services<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Right to information regarding quality, quantity, purity, standard and price<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Right to access goods and services at competitive prices<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Right to seek redressal against unfair or restrictive trade practices<\/span><\/li>\n<\/ul>\n<h3><b>Consumer Protection Councils<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act mandates the establishment of Consumer Protection Councils at the Central, State and District levels. These councils are advisory bodies aimed at promoting consumer awareness and rights.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Central Council is headed by the Union Minister of Consumer Affairs<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">State Councils are headed by State Consumer Affairs Ministers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">District Councils are headed by the District Collector<\/span><\/li>\n<\/ul>\n<h3><b>Central Consumer Protection Authority (CCPA)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act establishes the Central Consumer Protection Authority to promote, protect and enforce consumer rights. It is empowered to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Investigate violations of consumer rights<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Order recall of unsafe goods and services<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Discontinue unfair trade practices<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Impose penalties for misleading advertisements<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">File complaints before Consumer Disputes Redressal Commissions<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Issue safety notices to alert consumers<\/span><\/li>\n<\/ul>\n<h3><b>Misleading Advertisements<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act imposes strict penalties for false and misleading advertisements.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fine up to \u20b910 lakh and imprisonment up to two years for first offence<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fine up to \u20b950 lakh and imprisonment up to five years for subsequent offence<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Endorsers can also be penalised and banned from endorsing products<\/span><\/li>\n<\/ul>\n<h3><b>Consumer Disputes Redressal Commissions (CDRCs)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act establishes a three tier redressal system in which the appeals lie from District to State Commission, State to National Commission and finally to the Supreme Court. The three tier of redressal system includes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">District Commission: claims up to \u20b91 crore<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">State Commission: claims between \u20b91 crore and \u20b910 crore<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">National Commission: claims above \u20b910 crore<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Consumers can file complaints related to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unfair or restrictive trade practices<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Defective goods or deficient services<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Overcharging or deceptive pricing<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sale of hazardous goods or services<\/span><\/li>\n<\/ul>\n<h3><b>Adjudication Process<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The act has simplified the process of adjudication as compared to the 1986 act by the below mentioned means:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Electronic filing of complaints allowed<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Complaints can be filed where consumer resides or works<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Video conferencing permitted for hearings<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Complaint deemed admitted if not decided within 21 days<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Power of review granted to all commissions<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mandatory pre-deposit of 50% for appeals<\/span><\/li>\n<\/ul>\n<h3><b>Mediation<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">The Act introduces mediation as an Alternate Dispute Resolution mechanism.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Mediation cells attached to consumer commissions<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Cases referred for mediation with consent of parties<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Faster and less adversarial settlement<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No appeal against mediation settlement<\/span><\/li>\n<\/ul>\n<h3><b>Product Liability<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Product liability is a major innovation under the Act. The consumer has the following rights:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Protection against goods and services hazardous to life, health or property.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Access to correct information on quality, quantity, price, ingredients and standards to prevent unfair trade practices.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Freedom to access a variety of goods and services at competitive prices without coercion or monopoly pressure.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assurance that consumer interests will receive due consideration at appropriate forums and authorities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Right to fair settlement of genuine grievances, including compensation for defective goods or deficient services.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Right to acquire knowledge and skills to make informed consumer choices and protect against exploitation.<\/span><\/li>\n<\/ul>\n<h2><b>Government Initiatives for Consumer Protection<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The government has launched multiple initiatives to support the objectives of the Consumer Protection Act 2019.
