


{"id":86601,"date":"2026-02-07T16:06:41","date_gmt":"2026-02-07T10:36:41","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=86601"},"modified":"2026-02-07T17:07:18","modified_gmt":"2026-02-07T11:37:18","slug":"bonded-labour-act","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/bonded-labour-act\/","title":{"rendered":"Bonded Labour Act, Status, Provisions, Frameworks, Reasons &#038; Measures"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The <\/span><b>Bonded Labour System (Abolition) Act, 1976<\/b><span style=\"font-weight: 400;\"> is a law made by the Indian government to stop bonded labour. <\/span><b>Bonded labour<\/b><span style=\"font-weight: 400;\"> is when a person has to work for someone because they owe money, often unfairly, and cannot leave until the debt is paid.<\/span><\/p>\n<h2><b>Bonded Labour Act<\/b><\/h2>\n<p><b>According to Bonded Labour (Abolition) Act, 1976,<\/b> <b>Bonded labour<\/b><span style=\"font-weight: 400;\"> is a <\/span><b>type of forced or partly forced work<\/b><span style=\"font-weight: 400;\"> where a person (the bonded labourer) or their family member or any dependent person, has to work for a creditor because of a debt, social\/customary obligation, inheritance, economic consideration, or their birth in a certain caste or community. The labourer may work without wages or for very little pay, lose freedom of employment, be restricted in movement, or lose rights over their property or earnings.<\/span><\/p>\n<h2><b>Bonded Labour Status in India<\/b><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">According to the <\/span><b>Global Slavery Index 2023 by the Walk Free Foundation, an international human rights organisation, about 11 million people in India were living in modern slavery.<\/b><\/li>\n<li><span style=\"font-weight: 400;\">Modern slavery includes:<\/span>\n<ul>\n<li><b>Forced labour (working against their will)<\/b><\/li>\n<li><b>Debt bondage (working to pay off a loan)<\/b><\/li>\n<li><b>Forced marriage<\/b><\/li>\n<li><b>Other slavery-like practices, like forced sexual exploitation of adults and children<\/b><\/li>\n<li><b>Human trafficking<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has the highest total number of people in modern slavery in the world and the <\/span><b>sixth highest rate in the Asia Pacific region.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Globally, India is ranked 34th out of 160 countries<\/b><span style=\"font-weight: 400;\"> for the prevalence of modern slavery according to <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/global-slavery-index-2023\/\" target=\"_blank\"><b>Global Slavery Index 2023<\/b><\/a><span style=\"font-weight: 400;\">, with about <\/span><b>8 people in every 1,000 affected.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The population\u2019s vulnerability to modern slavery is<\/span><b> 56 out of 100, while the government\u2019s response rating is 46%<\/b><span style=\"font-weight: 400;\">, which is above the regional average.<\/span><\/li>\n<\/ul>\n<h2><b>Key Constitutional, Legal, and International Frameworks Prohibiting Bonded Labour in India<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">India has a strong constitutional, legal framework and has ratified international framework to prohibit bonded labour and protect human dignity. These provisions ensure freedom from forced labour, safeguard children and vulnerable groups, and support rehabilitation of victims.<\/span><\/p>\n<h3><b>Constitutional Protections Against Bonded Labour in India are:<\/b><\/h3>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 21<\/b><span style=\"font-weight: 400;\">: Every person has the right to life and personal liberty, which includes living with dignity.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 23:<\/b><span style=\"font-weight: 400;\"> Bans human trafficking, <\/span><i><span style=\"font-weight: 400;\">begar <\/span><\/i><span style=\"font-weight: 400;\">(forced labour without payment) and other similar forms of forced labour; such practices are illegal.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 24:<\/b><span style=\"font-weight: 400;\"> Children below 14 years cannot work in factories, mines, or hazardous jobs.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\"><b>Directive Principles:<\/b><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Article 42:<\/b><span style=\"font-weight: 400;\"> Ensures fair and humane working conditions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Article 43<\/b><span style=\"font-weight: 400;\">: Calls for decent wages and working conditions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Article 46:<\/b><span style=\"font-weight: 400;\"> Protects Scheduled Castes, Scheduled Tribes, and weaker sections from social injustice and exploitation, including bonded labour.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>India\u2019s Legal Framework<\/b><\/h3>\n<ul>\n<li><b>Bonded Labour System (Abolition) Act, 1976:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Abolishes bonded labour.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Frees bonded labourers and makes forcing people to work as illegal.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Sets up vigilance committees at district, sub-division, and block levels to implement the law.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 (amended 2016):<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Bans children under 14 from working.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Protects adolescents (14-18 years) from hazardous work.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Juvenile Justice (Care and Protection of Children) Act, 2015:<\/b><span style=\"font-weight: 400;\"> Protects children, provides rehabilitation and care.<\/span><\/li>\n<li><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/bharatiya-nyaya-sanhita-bill-2023-background-objectives-provisions\/\" target=\"_blank\">Bharatiya Nyaya Sanhita<\/a> (BNS), 2023:<\/b><span style=\"font-weight: 400;\"> Punishes forced labour and makes compulsory labour as illegal.<\/span><\/li>\n<li><b>Central Sector Scheme for Rehabilitation of Bonded Labourers, 2016:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Provides financial help after rescue (Rs 30,000 initially; up to Rs 1-3 lakh depending on the case).<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Gives non-cash support like housing, land, and livelihood opportunities.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Code on Wages, 2019:<\/b><span style=\"font-weight: 400;\"> Ensures minimum wages and timely payment for all workers.<\/span><\/li>\n<li><b>Vision and Action Plans by Ministry of Labour:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Aim to release and rehabilitate all bonded labourers.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Deal with modern forms of bondage like forced marriage, domestic servitude, organized begging, and forced recruitment.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>International Legal Frameworks<\/b><\/h3>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>United Nations Convention on the Rights of the Child (CRC), 1989:<\/b><span style=\"font-weight: 400;\"> Protects children from economic exploitation and hazardous work.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\"><b>ILO Conventions:<\/b><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Convention 182 (Worst Forms of <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/child-labour\/\" target=\"_blank\">Child Labour<\/a><\/strong>, 1999): India has ratified it to eliminate hazardous child labour.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Abolition of Forced Labour Convention, 1957: Seeks to end all forms of forced labour.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>Other Initiatives<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/national-human-rights-commission-nhrc\/\" target=\"_blank\"><b>National Human Rights Commission (NHRC)<\/b><\/a><span style=\"font-weight: 400;\"> organizes seminars and workshops in states prone to bonded labour (e.g., Gujarat, Maharashtra, Karnataka, Haryana, Uttar Pradesh).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/central-vigilance-commission\/\" target=\"_blank\"><b>Vigilance committees<\/b><\/a><span style=\"font-weight: 400;\"> and state governments are responsible for identifying, rescuing and rehabilitating bonded labourers.<\/span><\/li>\n<\/ul>\n<h2><b>Reasons for Bonded Labour in India<\/b><\/h2>\n<ul>\n<li aria-level=\"1\"><b>Poverty and Debt<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Many families are very poor and take loans they cannot repay. This forces them or their children to work for the lender, often in unfair conditions.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Low Wages<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Workers earning less than minimum wages may have to borrow money to survive. This can trap them in debt and bonded labour.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Caste-Based Discrimination<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Social hierarchies make marginalized communities, like Dalits and Adivasis, more likely to be exploited. The majority of bonded labourers come from these groups.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Lack of Education and Awareness<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Many workers and children do not know their rights, so they can be easily exploited.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Migration and Informal Work<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">People moving from villages to cities often work in the unorganized sector, where there are no proper labour protections, making them vulnerable to forced labour.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Debt Traps<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Families fall into cycles of debt, and even children are forced to work to repay loans with high interest rates.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Weak Law Enforcement<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Police and courts often lack enough staff, training, or resources to catch offenders and enforce anti-bonded labour laws effectively.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Landlessness<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">People without land have fewer economic options and bargaining power, which increases the risk of exploitation.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Exploitation in Agriculture and Other Sectors<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Large informal sectors, like farming or domestic work, exploit cheap labour, especially children.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Gender Discrimination<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Girls are often more vulnerable and are forced into bonded labour because of inequality.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Cultural Acceptance<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In some rural areas, child work is wrongly seen as normal or is disguised as \u201capprenticeship,\u201d keeping children in labour instead of school.<\/span><\/p>\n<h2><b>Measures to End Bonded Labour in India<\/b><\/h2>\n<ul>\n<li aria-level=\"1\"><b>Strong Law Enforcement<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The government should strictly enforce the Bonded Labour Abolition Act, 1976. Special committees should monitor cases, track complaints digitally and punish those who force others into bonded labour.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Identify and Rescue Workers<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Regular surveys and inspections should be done in high-risk areas like brick kilns, farms, and mines. Children and adults trapped in bonded labour should be rescued quickly.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Rehabilitation and Support<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Freed workers should get financial help, skill training, and legal support. They should also be helped to reintegrate into society and find proper jobs.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Education for Children<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Every child has the right to go to school. Education prevents children from being forced into labour and helps them build a better future. Vocational training should also be provided to adults for better employment opportunities.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Social and Financial Support for Families<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Poor families should get help through welfare schemes like the Public Distribution System (PDS) and MGNREGA. Direct cash transfers can reduce the family\u2019s dependence on children\u2019s income.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Awareness Campaigns<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">People should be taught about human rights and the laws that forbid bonded labour. Communities should understand that exploiting anyone is wrong and unacceptable.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Community and NGO Involvement<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Local communities and NGOs should work together to support rescued workers.
