This helps people vote freely without fear, pressure or influence. It is an important feature of free and fair elections. According to the Supreme Court, Secrecy of Ballot is the cornerstone of free and fair elections.<\/span><\/p>\n<h2><b>Secrecy of Ballot Case Background<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The case was related to a<\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/no-confidence-motion\/\" target=\"_blank\"><b> no-confidence motion<\/b><\/a><span style=\"font-weight: 400;\"> passed in a Zila Panchayat in Uttar Pradesh in 2018. The <\/span><b>Allahabad High Court<\/b> <b>cancelled the voting <\/b><span style=\"font-weight: 400;\">because some members were found to have violated the secrecy of the ballot. CCTV footage showed that certain members had displayed their ballot papers or behaved in a way that revealed how they voted.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The matter was<\/span><b> then challenged in the Supreme Court.<\/b><span style=\"font-weight: 400;\"> The Supreme Court referred to <\/span><b>Section 28(8)<\/b><span style=\"font-weight: 400;\"> of the Uttar Pradesh Kshettra Panchayat and Zila Panchayat Adhiniyam, 1961, which clearly states that a <\/span><b>no-confidence motion must be voted on through a secret ballot.<\/b><span style=\"font-weight: 400;\"> The Court ordered that the voting should be conducted again within two months, strictly following the <\/span><b>secret ballot system<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This case highlights the importance of secrecy of ballot in ensuring free and fair decision-making in democratic institutions.<\/span><\/li>\n<\/ul>\n<h2><b>Secrecy of Ballot Judgement<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Supreme Court stated that <\/span><b>secrecy of ballot is an essential feature<\/b><span style=\"font-weight: 400;\"> of constitutional democracy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law must <\/span><b>protect the voter\u2019s right<\/b><span style=\"font-weight: 400;\"> to keep their vote confidential.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Even a <\/span><b>small possibility<\/b><span style=\"font-weight: 400;\"> that a voter may be forced to reveal their vote can restrict their freedom to vote freely.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court referred to <\/span><b>Section 94 of the <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/representation-of-the-people-act-1951\/\" target=\"_blank\">Representation of the People Act<\/a>, 1951<\/b><span style=\"font-weight: 400;\">, which gives voters the right to maintain secrecy about their vote.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Secrecy of ballot is a <\/span><b>privilege given to the voter.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>A voter can voluntarily<\/b><span style=\"font-weight: 400;\"> give up this privilege and choose to disclose whom they voted for.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If a voter willingly reveals their vote, no one can stop them or make a complaint against them for doing so.<\/span><\/li>\n<\/ul>\n<h2><b>Representation of People\u2019s Act 1951<\/b><\/h2>\n<ul>\n<li><b>Section 94 of the RPA, 1951<\/b><span style=\"font-weight: 400;\"> protects the voter\u2019s right to keep their vote secret. It gives voters the privilege to not disclose whom they voted for.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Free and fair elections are the foundation of democracy.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">To ensure fair elections, the Constitution includes <\/span><b>Part XV (Articles 324-329)<\/b><span style=\"font-weight: 400;\">, which deals with <\/span><b>elections<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li><b>Article 324<\/b><span style=\"font-weight: 400;\"> provides for the establishment of the <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/election-commission-of-india-eci\/\" target=\"_blank\">Election Commission of India<\/a> (ECI), which<\/span><b> supervises and conducts elections.<\/b><\/li>\n<li><b>Parliament passed two important laws:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Representation of the People Act, 1950<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Representation of the People Act, 1951<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Key Provisions of the RPA, 1951:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Regulates the conduct of general elections and by-elections.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Provides the administrative system for conducting elections.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Deals with registration of political parties.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Defines qualifications and disqualifications for MPs and MLAs.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Contains rules to prevent corrupt practices and electoral offences.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Provides procedures to resolve election disputes.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>Elections Where Secret Ballot is not used<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Rajya Sabha Elections<\/b><span style=\"font-weight: 400;\">: Voting is done through an open ballot system where MLAs must show their marked ballot to the authorised party agent (as per provisions of the Representation of the People Act, 1951).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Elections to State Legislative Councils (by MLAs)<\/b><span style=\"font-weight: 400;\">: Open ballot system is followed to prevent cross-voting and ensure party discipline.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Voting in Parliament and State Legislatures: <\/b><span style=\"font-weight: 400;\">Most decisions (e.g., passing of Bills, motions) are taken through voice vote or division, not by secret ballot.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Internal Proceedings of Local Bodies or Legislatures:<\/b><span style=\"font-weight: 400;\"> Certain resolutions may be decided by show of hands or open voting, unless law specifically requires a secret ballot.<\/span><\/li>\n<\/ul>\n<h2><b>Measures to Ensure Free and Fair Elections<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Totalisers combine votes from several EVMs before counting, so it is not possible to know voting patterns of a particular booth. This protects voter secrecy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Secure online voting systems can help maintain secrecy and increase participation, especially for remote voters.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Polling stations should be located close to voters\u2019 residences so that people of all ages and genders can vote easily.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Political party workers should not be allowed near polling stations to prevent influence or pressure on voters.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Both Citizens and the Election Commission must work responsibly to protect the secrecy of the ballot and ensure free, fair and transparent elections for good governance.<\/span><\/li>\n<\/ul>\n<h2><b>Right to Vote in India<\/b><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">The right to vote in India is provided by the Constitution and election laws, but it is subject to certain conditions.<\/span><\/li>\n<li><b>Article 326<\/b><span style=\"font-weight: 400;\"> of the Constitution provides for universal adult franchise.
