The amendment <\/span><b>empowered the State to make special provisions for socially and educationally backward classes, Scheduled Castes, and Scheduled Tribes <\/b><span style=\"font-weight: 400;\">in matters of <\/span><b>admission to educational institutions<\/b><span style=\"font-weight: 400;\">, including <\/span><b>private institutions.<\/b><\/p>\n<h2><b>93rd Constitutional Amendment Act Background<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The education sector in India underwent major changes after the 1990s. Economic liberalization encouraged private investment in higher education. As a result, the number of private professional colleges increased significantly. However, this growth also created concerns about unequal access to quality education. Admission to many private institutions was primarily based on competitive merit, which indirectly disadvantaged students from socially and educationally backward communities.<\/span><\/p>\n<p><b>Students from weaker sections often faced challenges such as lack of access to quality schooling, coaching facilities, and educational resources.<\/b><span style=\"font-weight: 400;\"> Consequently, their <\/span><b>representation in professional courses remained relatively low.<\/b><span style=\"font-weight: 400;\"> To address these concerns and promote inclusive access to higher education, the 93rd Constitutional Amendment Act, 2005 was introduced.<\/span><\/p>\n<h2><b>93rd Constitutional Amendment Act Objectives\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The main objective of the 93rd Constitutional Amendment Act was:\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To promote inclusive education and ensure greater social equality.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To expand the scope of reservation policy in higher education.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To address the impact of privatization in education.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The <\/span><b>amendment was also aligned with the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/directive-principles-of-state-policy-dpsp\/\" target=\"_blank\">Directive Principles of State Policy<\/a>,<\/b><span style=\"font-weight: 400;\"> especially <\/span><b>Article 46<\/b><span style=\"font-weight: 400;\">, which directs the State to promote the educational and economic interests of weaker sections of society.<\/span><\/p>\n<h2><b>93rd Constitutional Amendment Act Provisions\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The most important provision introduced by the 93rd Constitutional Amendment Act was the <\/span><b>addition of clause (5) in Article 15 of the Constitution.\u00a0<\/b><\/p>\n<p><b>Article 15(5) <\/b><span style=\"font-weight: 400;\">gives the State the power to make special laws for the advancement of socially and educationally backward classes, Scheduled Castes, and Scheduled Tribes. This provision mainly deals with admission to educational institutions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><b>important features of 93rd Constitutional Amendment Act are:<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">It applies to a wide range of educational institutions including private universities, professional colleges, technical institutes, and other higher education institutions.<\/span><\/li>\n<li><b>Both government-aided and private unaided institutions are covered.<\/b><\/li>\n<li><b>Educational institutions established by religious and linguistic minorities under Article 30 are exempted<\/b><span style=\"font-weight: 400;\"> from reservation requirements. This was done to protect the constitutional rights of minorities to preserve and administer their educational institutions.<\/span><\/li>\n<li><b>Reservation or special provisions must be made through proper legislation<\/b><span style=\"font-weight: 400;\">. This means that the State cannot implement such policies arbitrarily through executive orders and must follow the law-making process.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">This provision also <\/span><b>limits Article 19(1)(g)<\/b><span style=\"font-weight: 400;\">, which guarantees the right to carry on any profession or business, to the extent necessary for implementing reservation policy.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The amendment mainly focuses on admission processes in educational institutions. It <\/span><b>does not give unlimited control to the government over the internal administration of private institutions<\/b><span style=\"font-weight: 400;\"> but <\/span><b>allows reasonable intervention<\/b><span style=\"font-weight: 400;\"> to promote social justice.<\/span><\/li>\n<\/ul>\n<h2><b>93rd Constitutional Amendment Act Judicial Validity<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The constitutional validity of the 93rd Constitutional Amendment Act was challenged before the Supreme Court. In the case of <\/span><b>Ashoka Kumar Thakur v. Union of India<\/b><span style=\"font-weight: 400;\">, the Supreme Court upheld the validity of the amendment and held that it <\/span><b>does not violate the basic structure of the Constitution.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Court observed that the amendment promotes the constitutional value of equality by enabling affirmative action for socially and educationally backward classes, Scheduled Castes, and Scheduled Tribes. It further stated that reservation policies are justified in the Indian context because many communities have historically faced social and educational discrimination.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judgment also highlighted the concept of <\/span><b>substantive equality<\/b><span style=\"font-weight: 400;\">, explaining that equality does not simply mean treating everyone in the same manner.
