This amendment introduced the concept of <\/span><b>\u201cconsequential seniority\u201d<\/b><span style=\"font-weight: 400;\"> for SC\/ST employees who are promoted through reservation in public employment.<\/span><\/p>\n<h2><b>85th Constitutional Amendment Act Background<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><b>85th Constitutional Amendment Act<\/b><span style=\"font-weight: 400;\"> was introduced to address issues related to <\/span><b>reservation in promotion for Scheduled Castes (SCs) and Scheduled Tribes (STs)<\/b><span style=\"font-weight: 400;\"> in government services. Earlier court judgments created uncertainty regarding the <\/span><b>seniority of SC\/ST employees promoted through reservation<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To resolve this issue and protect their service rights, the amendment modified <\/span><b>Article 16<\/b><span style=\"font-weight: 400;\"> by introducing the concept of <\/span><b>consequential seniority<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>Indra Sawhney v. Union of India<\/b><span style=\"font-weight: 400;\"> judgment limited reservation in promotions, creating concerns about representation of SC\/ST employees in higher government href=\"https:\/\/vajiramandravi.com\/current-affairs\/77th-constitutional-amendment-act\/\" target=\"_blank\"><b>77th Constitutional Amendment Act<\/b><\/a><span style=\"font-weight: 400;\">, <\/span><b>81st Constitutional Amendment Act<\/b><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-82-of-indian-constitution\/\" target=\"_blank\"><b>82nd Constitutional Amendment Act<\/b><\/a><span style=\"font-weight: 400;\"> to address reservation issues.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Despite these measures, seniority disputes continued, leading to the enactment of the <\/span><b>85th Constitutional Amendment Act in 2001<\/b><span style=\"font-weight: 400;\"> with retrospective effect from <\/span><b>17 June 1995<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2><b>85th Constitutional Amendment Act Objectives<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The major objectives of the 85th Constitutional Amendment Act are:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To provide <\/span><b>consequential seniority<\/b><span style=\"font-weight: 400;\"> to SC\/ST employees promoted through reservation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To ensure <\/span><b>adequate representation of SC\/ST communities in higher government posts<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To protect the <\/span><b>service rights and career progression<\/b><span style=\"font-weight: 400;\"> of SC\/ST employees.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To strengthen the <\/span><b>reservation policy in public employment<\/b><span style=\"font-weight: 400;\"> and promote social justice.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To maintain the constitutional principle of <\/span><b>equal opportunity in government services<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2><b>85th Constitutional Amendment Act Provisions<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The amendment modified <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-16-of-indian-constitution\/\" target=\"_blank\"><b>Article 16<\/b><\/a><span style=\"font-weight: 400;\">, particularly <\/span><b>Article 16(4A)<\/b><span style=\"font-weight: 400;\">, to provide <\/span><b>reservation in promotion with consequential seniority<\/b><span style=\"font-weight: 400;\"> for SC\/ST employees.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Amendment to Article style=\"font-weight: 400;\"> The provisions apply to <\/span><b>government services and public sector employment<\/b><span style=\"font-weight: 400;\"> where reservation policies are implemented.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Strengthening Social Justice:<\/b><span style=\"font-weight: 400;\"> The amendment aims to ensure <\/span><b>fair representation of historically disadvantaged communities in higher administrative positions<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2><b>85th Constitutional Amendment Act Case Laws<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Several important judgments of the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\"><b>Supreme Court of India<\/b><\/a><span style=\"font-weight: 400;\"> have interpreted and clarified the provisions related to the <\/span><b>85th Constitutional Amendment Act<\/b><span style=\"font-weight: 400;\"> and other amendments dealing with <\/span><b>reservation in promotions for Scheduled Castes (SCs) and Scheduled Tribes (STs)<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<ol>\n<li><b> M. Nagaraj v. Union of India: <\/b><span style=\"font-weight: 400;\">In this landmark judgment, the Supreme Court examined the constitutional validity of the 77th, 81st, 82nd, and 85th Constitutional Amendments. The Court upheld these amendments but stated that the government must collect quantifiable data before providing reservation in promotions. The data should prove the backwardness of the class, inadequate representation in services, and maintenance of administrative efficiency.<\/span><\/li>\n<li><b>2. Jarnail Singh v. Lachhmi Narain Gupta:<\/b><span style=\"font-weight: 400;\"> In this case, the Supreme Court partly modified the earlier judgment in the M. Nagaraj case. The Court ruled that the government does not need to prove the backwardness of SC\/ST communities again, as they are already recognized as backward under the Constitution.
