


{"id":92110,"date":"2026-03-11T10:10:59","date_gmt":"2026-03-11T04:40:59","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=92110"},"modified":"2026-03-11T12:13:02","modified_gmt":"2026-03-11T06:43:02","slug":"cec-removal-motion","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/cec-removal-motion\/","title":{"rendered":"CEC Removal Motion: Legal Provisions for Removing the Chief Election Commissioner"},"content":{"rendered":"<h2><b>CEC Removal Motion Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Opposition is preparing to move a motion to impeach Chief Election Commissioner (CEC) Gyanesh Kumar, alleging biased conduct.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The removal process will follow the same procedure as that for removing a Supreme Court judge, as provided under the law.<\/span><\/li>\n<\/ul>\n<h2><b>Opposition\u2019s Allegations Against the CEC<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Opposition is drafting an impeachment motion against Chief Election Commissioner Gyanesh Kumar and is gathering the required signatures from MPs.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The primary allegation is \u201c<\/span><b>biased conduct<\/b><span style=\"font-weight: 400;\">\u201d, with the EC accused of targeting West Bengal during the Special Intensive Revision of electoral rolls, including the deployment of micro-observers in the state.<\/span><\/li>\n<\/ul>\n<h2><b>Process for Removal of the Chief Election Commissioner (CEC)<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The removal of the Chief Election Commissioner (CEC) is governed by <\/span><b>Article 324(5)<\/b><span style=\"font-weight: 400;\"> of the Constitution.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It states that the CEC can be removed only in the same manner and on the same grounds as a judge of the Supreme Court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Article also provides that Election Commissioners can be removed only on the recommendation of the Chief Election Commissioner.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The removal process is subject to laws enacted by Parliament.<\/span><\/li>\n<\/ul>\n<h3><b>Legal Framework<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Parliament enacted the <\/span><b>Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Section 11 of this Act deals with the resignation and removal process.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It reiterates the constitutional provision that the CEC can only be removed in the same manner as a Supreme Court judge.<\/span><\/li>\n<\/ul>\n<h3><b>Grounds for Removal<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The grounds for removal are the same as those applicable to Supreme Court judges under Article 124(4):<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Proved misbehaviour, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Incapacity<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>Parliamentary Procedure for Removal<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The removal process follows the procedure laid down in the <\/span><b>Judges (Inquiry) Act, 1968<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Initiation of Motion &#8211; <\/b><span style=\"font-weight: 400;\">A motion for removal must be signed by: At least 100 members of the Lok Sabha, or At least 50 members of the Rajya Sabha.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Admission of Motion<\/b><span style=\"font-weight: 400;\"> &#8211;
