


{"id":94952,"date":"2026-03-26T10:57:38","date_gmt":"2026-03-26T05:27:38","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=94952"},"modified":"2026-03-26T10:59:30","modified_gmt":"2026-03-26T05:29:30","slug":"wto-mc14-key-battles-over-trade-rules","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/wto-mc14-key-battles-over-trade-rules\/","title":{"rendered":"WTO MC14 Key Battles Over Trade Rules and Global Equity Explained"},"content":{"rendered":"<h2><b>WTO MC14 Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The WTO\u2019s 14th Ministerial Conference (MC14) will be held from March 26\u201329 in Yaound\u00e9, Cameroon.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As the organisation\u2019s highest decision-making body, it meets roughly every two years and has the authority to take decisions on WTO rules and set the future direction of global trade negotiations.<\/span><\/li>\n<\/ul>\n<h2><b>MC14: A Multilateral Meeting in a Unilateral World<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The MC14 is taking place against a deeply troubled backdrop for global trade.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rising US-China geopolitical rivalry, ongoing global conflicts, and the increasing securitisation of trade relations have collectively weakened the foundations of multilateral cooperation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Most significantly, trade multilateralism is in retreat as unilateralism surges. The US has launched a sweeping assault on the WTO-based trading order by <\/span><b>weaponising tariffs<\/b><span style=\"font-weight: 400;\"> \u2014 imposing them arbitrarily in ways that violate two cardinal <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/world-trade-organisation\/\" target=\"_blank\"><strong>WTO<\/strong><\/a> principles:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The <\/span><b>Most Favoured Nation (MFN) Rule<\/b><span style=\"font-weight: 400;\"> \u2014 which prohibits discriminatory treatment between trading partners.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Bound Rate Obligations<\/b><span style=\"font-weight: 400;\"> \u2014 which prevent countries from imposing tariffs beyond mutually agreed ceilings.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Beyond tariffs, the US has also begun negotiating <\/span><b>one-sided<\/b><span style=\"font-weight: 400;\"> bilateral trade agreements through <\/span><b>tariff coercion<\/b><span style=\"font-weight: 400;\"> \u2014 pressuring countries into deals on American terms, further bypassing the multilateral framework that the WTO was built to uphold.<\/span><\/li>\n<\/ul>\n<h2><b>Why Trade Multilateralism Is in Crisis<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The roots of the crisis lie in Washington&#8217;s growing belief that the WTO \u2014 which the US itself was instrumental in creating in 1995 \u2014 has not served American interests.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Two developments have driven this disillusionment:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>China&#8217;s Rise<\/b><span style=\"font-weight: 400;\"> \u2014 China&#8217;s meteoric economic growth over the past two decades has significantly narrowed the power gap between Washington and Beijing.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Failed Expectations<\/b><span style=\"font-weight: 400;\"> \u2014 The US had hoped that China&#8217;s WTO accession (which it facilitated) would discipline Beijing&#8217;s state-led industrial policies. It did not.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>The US Response: Dismantling the WTO from Within<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rather than reforming the WTO, the US chose to weaken it:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It paralysed the <\/span><b>WTO&#8217;s Appellate Body<\/b><span style=\"font-weight: 400;\"> \u2014 the organisation&#8217;s highest judicial arm \u2014 by relentlessly blocking the appointment of its members.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Without a functioning Appellate Body, the <\/span><b>WTO&#8217;s dispute settlement system<\/b><span style=\"font-weight: 400;\"> \u2014 its most powerful enforcement tool \u2014 has been rendered ineffective.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This gives the US the freedom to act outside WTO legal constraints and confront China on its own terms<\/span><\/li>\n<\/ul>\n<h3><b>The WTO&#8217;s Internal Weakness: Consensus Paralysis<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Beyond US actions, the WTO suffers from a <\/span><b>structural weakness<\/b><span style=\"font-weight: 400;\"> \u2014 its consensus-based decision-making makes drafting new trade rules extremely slow.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In over three decades, the WTO has produced only two new agreements:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Trade Facilitation Agreement<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Agreement on Fisheries Subsidies<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This sluggishness has pushed countries to seek trade rule-making through Free Trade Agreements (FTAs) \u2014 bypassing the multilateral framework altogether.<\/span><\/li>\n<\/ul>\n<h2><b>Key Issues at MC14<\/b><\/h2>\n<p><strong>1. Plurilateral<\/strong><b> Agreements: A Way Forward or a Pandora&#8217;s Box<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">A central debate at MC14 is whether plurilateral agreements \u2014 deals between fewer than all WTO members \u2014 should be incorporated into the WTO rulebook (Annex 4).\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Two key agreements are in focus:<\/span>\n<ul>\n<li><strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/ifd-agreement-at-wto\/\" target=\"_blank\">Investment Facilitation for Development<\/a><\/strong><span style=\"font-weight: 400;\"> \u2014 endorsed by 120+ countries<\/span><\/li>\n<li><b>Agreement on Electronic Commerce<\/b><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">While inclusion in Annex 4 requires consensus among all members, many countries see plurilateral agreements as the best way to reinvigorate the WTO&#8217;s stalled legislative function.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">India, however, warns that opening this door could fragment the system \u2014 a logjam MC14 must resolve.<\/span><\/li>\n<\/ul>\n<p><b>2. The E-Commerce Moratorium<\/b><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">First agreed in 1998 and renewed every two years, this moratorium prevents WTO members from imposing tariffs on electronic transmissions. It is set to expire on March 31. Developed countries want it made permanent.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Developing countries like India are reluctant \u2014 as digital trade has surged, continuing the moratorium could mean significant revenue losses.<\/span><\/li>\n<\/ul>\n<p><b>3. Special and Differential Treatment (SDT)<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">SDT recognises that not all WTO members are on equal footing and grants special rights to developing countries and LDCs.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The US wants to weaken SDT by excluding larger developing economies \u2014 China, India, Brazil, and Indonesia \u2014 from its benefits. Developing countries must strongly resist this move.<\/span><\/li>\n<\/ul>\n<p><b>4. Restoring the Appellate Body<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">With the WTO&#8217;s dispute settlement system paralysed by the US blocking Appellate Body appointments, MC14 must unequivocally demand its restoration to put the WTO&#8217;s judicial function back on track.<\/span><\/li>\n<\/ul>\n<p><b>5.
