It prohibits communicating the sex of the foetus and provides penalties for violations. The Act is closely linked with the constitutional guarantees of <\/span><b>equality and non-discrimination under Articles 14 and 15 and<\/b><span style=\"font-weight: 400\"> the <\/span><b>right to life and dignity under Article 21<\/b><span style=\"font-weight: 400\">, reinforcing the constitutional commitment to gender equality.<\/span><\/p>\r\n<h2><span style=\"font-weight: 400\">PCPNDT Act Background<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">The<\/span><b> PCPNDT<\/b><span style=\"font-weight: 400\"> Act did not emerge in isolation; it was a legislative response to a deepening demographic and social crisis driven by son preference and the misuse of emerging medical technology.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Declining Child Sex Ratio:<\/b><span style=\"font-weight: 400\"> A persistent decline in India's sex ratio, from 972 females per 1,000 males (1901) to 927 (1991), highlighted the growing prevalence of gender discrimination and female foeticide.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Shift from Infanticide to Foeticide: <\/b><span style=\"font-weight: 400\">The widespread use of ultrasound and prenatal diagnostic techniques in the <\/span><b>1980s and 1990s <\/b><span style=\"font-weight: 400\">enabled sex-selective abortions, shifting the practice from female infanticide to female foeticide.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Maharashtra's Pioneering Legislation:<\/b><span style=\"font-weight: 400\"> The Maharashtra Regulation of Prenatal Diagnostic Techniques Act, 1988, was India's first State law to prohibit sex determination and served as the model for the subsequent national legislation.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Enactment and Strengthening of the PCPNDT Act:<\/b><span style=\"font-weight: 400\"> The <\/span><b>Act <\/b><span style=\"font-weight: 400\">was enacted in 1994 and came into force in 1996.<\/span>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The <\/span><b>2003 amendment expanded<\/b><span style=\"font-weight: 400\"> its scope to prohibit pre-conception sex selection, regulate ultrasound clinics, and strengthen institutional oversight through Central and State Supervisory Boards.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">PCPNDT Constitutional Basis<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">The PCPNDT Act derives its constitutional legitimacy from the principles of equality, dignity, life, and the State's obligation to protect women and children.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Article 14:<\/b><span style=\"font-weight: 400\"> Ensures equality before the law by combating gender-based discrimination through sex selection.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Article 15(1) &amp; 15(3):<\/b><span style=\"font-weight: 400\"> Prohibits discrimination on the ground of sex while permitting special laws for the protection of women and children.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/article-21\/\" target=\"_blank\">Article 21<\/a>:<\/b><span style=\"font-weight: 400\"> Protects the right to life and dignity of the girl child by preventing sex-selective elimination.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Article 39(f):<\/b><span style=\"font-weight: 400\"> Directs the State to ensure that children develop in conditions of freedom and dignity.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Article 42:<\/b><span style=\"font-weight: 400\"> Encourages the State to secure humane conditions and maternity protection.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Article 51A(e):<\/b><span style=\"font-weight: 400\"> Imposes a Fundamental Duty on citizens to renounce practices derogatory to the dignity of women.\u00a0<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">PCPNDT Act Provisions<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">The PCPNDT Act establishes a multi-layered regulatory framework spanning prohibition, registration, oversight, and penalties. Its key provisions are as follows:<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Prohibition of Sex Selection (Sections 3A and 6):<\/b><span style=\"font-weight: 400\"> The<\/span><b>\u00a0Act <\/b><span style=\"font-weight: 400\">prohibits sex selection before or after conception and bans any person from conducting or assisting in such practices.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Regulation of Diagnostic Techniques (Section 4): <\/b><span style=\"font-weight: 400\">The <\/span><b>Act<\/b><span style=\"font-weight: 400\"> permits prenatal diagnostic techniques only for detecting specified genetic or congenital disorders and strictly prohibits their use for sex determination.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Mandatory Registration under the PCPNDT Act (Sections 3, 3B and 18):<\/b><span style=\"font-weight: 400\"> All genetic counselling centres, laboratories, and clinics using prenatal diagnostic techniques must be registered under the<\/span><b>\u00a0Act<\/b><span style=\"font-weight: 400\">. Sale of ultrasound machines to unregistered centres is prohibited.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Consent and Non-Disclosure Provisions (Sections 5 and 6):<\/b><span style=\"font-weight: 400\"> The<\/span><b>\u00a0Act <\/b><span style=\"font-weight: 400\">mandates written informed consent of the pregnant woman and prohibits disclosure of the sex of the foetus to anyone.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Supervisory and Regulatory Bodies (Sections 7, 16A, 17 and 17A):<\/b><span style=\"font-weight: 400\"> The<\/span><b>\u00a0Act<\/b><span style=\"font-weight: 400\"> establishes <\/span><b>Central and State Supervisory Boards and empowers Appropriate Authorities <\/b><span style=\"font-weight: 400\">to monitor implementation, investigate violations, and suspend or cancel registrations.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Ban on Advertisements (Section 22):<\/b><span style=\"font-weight: 400\"> The <\/span><b>Act<\/b><span style=\"font-weight: 400\"> prohibits all advertisements relating to sex determination or sex selection, including through electronic and online media.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Offences and Penalties under the PCPNDT Act (Sections 23-28):<\/b><span style=\"font-weight: 400\"> Violations of the <\/span><b>Act<\/b><span style=\"font-weight: 400\"> attract imprisonment, fines, and suspension or removal of medical practitioners from the medical register.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Protection of Pregnant Women (Section 24): <\/b><span style=\"font-weight: 400\">The <\/span><b>Act<\/b><span style=\"font-weight: 400\"> protects pregnant women forced to undergo sex determination procedures and presumes coercion by relatives or the husband in such cases.<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">PCPNDT Act Challenges<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">Despite its robust legal framework, the <\/span><b>PCPNDT Act<\/b><span style=\"font-weight: 400\"> has faced persistent challenges in implementation that have limited its effectiveness in reversing the decline in child sex ratio.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Continued Decline in Child Sex Ratio:<\/b><span style=\"font-weight: 400\"> Despite the enactment of the<\/span><b>\u00a0Act<\/b><span style=\"font-weight: 400\">, the child sex ratio (0\u20136 years) declined from<\/span><b> 945 in 1991 to 927 in 2001<\/b><span style=\"font-weight: 400\"> and further to 914 in 2011, raising concerns about the effectiveness of implementation.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Deep-Rooted Son Preference:<\/b><span style=\"font-weight: 400\"> The effectiveness of the <\/span><b>Act <\/b><span style=\"font-weight: 400\">is limited by entrenched patriarchy, gender bias, and strong societal preference for sons, which cannot be addressed through legislation alone.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Weak Enforcement of the PCPNDT Act:<\/b><span style=\"font-weight: 400\"> Poor monitoring, corruption, lack of awareness, social complicity, and judicial delays continue to weaken enforcement of the <\/span><b>Act <\/b><span style=\"font-weight: 400\">at the ground level.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Misuse of Digital Platforms:<\/b><span style=\"font-weight: 400\"> The challenge before the<\/span><b>\u00a0Act<\/b><span style=\"font-weight: 400\"> has expanded to digital platforms, where influencers and unqualified individuals promote illegal or unscientific gender-prediction methods online.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Institutional and Procedural Gaps:<\/b><span style=\"font-weight: 400\"> Courts have highlighted the need to revisit certain provisions of the <\/span><b>Act,<\/b><span style=\"font-weight: 400\"> particularly regarding police powers, raids, seizures, and procedural alignment with criminal law.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Limited Regulatory Scope of the PCPNDT Act:<\/b><span style=\"font-weight: 400\"> While the <\/span><b>Act<\/b><span style=\"font-weight: 400\"> mainly regulates clinic-based prenatal diagnostic procedures, emerging technologies such as IVF and pre-implantation genetic diagnosis pose new regulatory challenges.<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">PCPNDT Act Way Forward<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">Addressing the limitations of the <\/span><b>PCPNDT Act <\/b><span style=\"font-weight: 400\">requires a comprehensive approach that combines stronger enforcement mechanisms, adaptation to emerging technologies, and sustained social and behavioural change.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Strengthening Enforcement of the PCPNDT Act:<\/b><span style=\"font-weight: 400\"> Appropriate authorities under the Act must be adequately staffed, trained, and empowered to ensure regular inspections, timely investigations, and swift prosecution of violations.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Regulating Digital Platforms:<\/b><span style=\"font-weight: 400\"> The <\/span><b>PCPNDT Act <\/b><span style=\"font-weight: 400\">should be expanded to explicitly regulate online promotion of sex determination services and enable coordination with IT authorities to remove illegal digital content.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Technology-Responsive Framework: <\/b><span style=\"font-weight: 400\">The <\/span><b>Act<\/b><span style=\"font-weight: 400\"> must be periodically updated to regulate emerging technologies such as advanced IVF techniques, non-invasive prenatal testing, and AI-based imaging that may facilitate sex selection.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Convergence with Welfare Schemes: <\/b><span style=\"font-weight: 400\">Effective implementation of the<\/span><b> PCPNDT Act <\/b><span style=\"font-weight: 400\">should be combined with initiatives such as Beti Bachao Beti Padhao to address the social roots of son preference through awareness, education, and women\u2019s empowerment.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Community Awareness and Social Change:<\/b><span style=\"font-weight: 400\"> Long-term success of the<\/span><b>\u00a0Act <\/b><span style=\"font-weight: 400\">requires community participation, school-level sensitisation, and involvement of local women\u2019s organisations to challenge patriarchal attitudes and son preference.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Judicial Reforms:<\/b><span style=\"font-weight: 400\"> Fast-track courts and dedicated judicial mechanisms should be established for speedy disposal of cases under the <\/span><b>PCPNDT Act.<\/b><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Periodic Review of the PCPNDT Act: <\/b><span style=\"font-weight: 400\">The <\/span><b>Act<\/b><span style=\"font-weight: 400\"> should undergo
