The President can direct states on financial propriety, regulate expenditure, oversee financial legislation, and even reduce the salaries of government employees and judges, thereby suspending the normal fiscal autonomy of states until the emergency is lifted.<\/span><\/p>\r\n<h2><span style=\"font-weight: 400\">Financial Emergency Meaning<\/span><\/h2>\r\n<p><b>Financial Emergency <\/b><span style=\"font-weight: 400\">describes circumstances where the financial stability or credit of India, or any part of its territory, is threatened. It represents a grave economic crisis situation that poses a significant risk to the nation's financial well-being and economic security.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Unlike the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/national-emergency-in-india\/\" target=\"_blank\"><b>National Emergency<\/b><\/a><b>, this emergency <\/b><span style=\"font-weight: 400\">has never been invoked in India, even during serious financial challenges.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Its presence in the Constitution acts as a safeguard against extreme financial instability and ensures preparedness to protect the nation's economic security.<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">Financial Emergency Article 360<\/span><\/h2>\r\n<p><b>Financial Emergency<\/b><span style=\"font-weight: 400\"> Provisions are laid down in <\/span><b>Article 360 of the <\/b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/indian-constitution\/\" target=\"_blank\"><b>Indian Constitution<\/b><\/a><span style=\"font-weight: 400\">, which empowers the President of India to take extraordinary measures to restore financial stability during a grave economic crisis. <\/span><span style=\"font-weight: 400\">The idea of Financial Emergency is taken from the Weimar Constitution of Germany, <\/span><span style=\"font-weight: 400\">demonstrating the framers' intention to learn from international constitutional frameworks to address potential economic crises.<\/span><\/p>\r\n<h3><span style=\"font-weight: 400\">Financial Emergency Judicial Review<\/span><\/h3>\r\n<p><b>Article 360 of the Indian Constitution<\/b><span style=\"font-weight: 400\">\u2019s scope of judicial review has evolved through the 38th Constitutional Amendment Act and the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/44th-constitutional-amendment-act\/\" target=\"_blank\"><b>44th Constitutional Amendment Act<\/b><\/a><span style=\"font-weight: 400\">:<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>38th Amendment Act, 1975<\/b><span style=\"font-weight: 400\">: It provided that the satisfaction of the<\/span><b> President of India<\/b><span style=\"font-weight: 400\"> in issuing a Proclamation of Financial Emergency would be final and conclusive. This amendment placed the President\u2019s decision beyond judicial scrutiny, thereby making the Proclamation immune from challenge in any court.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>44th Amendment Act, 1978:<\/b><span style=\"font-weight: 400\"> The amendment act reversed the 1975 amendment by removing the bar on judicial review. Consequently, the President\u2019s satisfaction is now subject to judicial scrutiny. Courts can examine whether the Proclamation adheres to constitutional requirements or if it has been issued in a mala fide, arbitrary, or unreasonable manner.<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">Financial Emergency Proclamation<\/span><\/h2>\r\n<p><b>A financial emergency under Article 360 of the Indian Constitution <\/b><span style=\"font-weight: 400\">can be declared when the <\/span><strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/president-of-india\/\" target=\"_blank\">President of India<\/a><\/strong><span style=\"font-weight: 400\"> is convinced that India's financial stability or creditworthiness, or that of any part of the country, is under threat. This allows the Union to take special measures to protect the country\u2019s financial integrity.<\/span><\/p>\r\n<h3><span style=\"font-weight: 400\">Financial Emergency\u2019s Parliamentary Approval<\/span><\/h3>\r\n<p><span style=\"font-weight: 400\">A Proclamation for a financial emergency must be laid before each House of Parliament. Such approval requires only a simple majority in both Houses.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">It ceases to operate after two months unless approved by resolutions of both Houses within that period.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">The proclamation remains in force if the Lok Sabha is dissolved at the time of issue or during the two-month period, but the Rajya Sabha has approved it.<\/span>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">In such a case, the Proclamation will cease after thirty days from the first sitting of the new Lok Sabha unless approved by it within that period.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<h3><span style=\"font-weight: 400\">Financial Emergency Duration<\/span><\/h3>\r\n<p><b>A financial emergency in India, <\/b><span style=\"font-weight: 400\">once approved by both Houses of Parliament, continues indefinitely until it is revoked by the President. There is no maximum time limit prescribed for its operation, nor is repeated parliamentary approval required for its continuation.<\/span><\/p>\r\n<h2><span style=\"font-weight: 400\">Financial Emergency Revocation<\/span><\/h2>\r\n<p><b>A financial emergency<\/b><span style=\"font-weight: 400\"> under <\/span><b>Article 360 of the Indian Constitution<\/b><span style=\"font-weight: 400\"> can be revoked by the President whenever deemed appropriate by issuing a subsequent Proclamation.
