Enacted in the aftermath of the <\/span><span style=\"font-weight: 400\">Maratha Reservation Case (<\/span><i><span style=\"font-weight: 400\">Jaishri Laxmanrao Patil v. Chief Minister<\/span><\/i><span style=\"font-weight: 400\">, 2021)<\/span><span style=\"font-weight: 400\">, the amendment clarified the scope of the <\/span><span style=\"font-weight: 400\">102nd Constitutional Amendment<\/span><span style=\"font-weight: 400\"> and reaffirmed India's federal structure.<\/span><\/p>\r\n<p><span style=\"font-weight: 400\">The 105th Constitutional Amendment Act amended <\/span><b>Articles 338B, 342A and 366<\/b><span style=\"font-weight: 400\"> to enable States to maintain their own SEBC lists independent of the Central List. The amendment strengthened cooperative federalism while ensuring continued access to reservation benefits for backward communities in education and public employment.<\/span><\/p>\r\n<h2><span style=\"font-weight: 400\">105th Constitutional Amendment Act 2021 Background\u00a0<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">The <\/span><b>105th Constitutional Amendment Act<\/b><span style=\"font-weight: 400\"> was enacted to restore the States' authority to identify SEBCs after the Supreme Court interpreted the 102nd Constitutional Amendment as vesting this power exclusively in the Central Government.<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/102nd-constitutional-amendment-act\/\" target=\"_blank\">102nd Constitutional Amendment Act<\/a> (2018):<\/b><span style=\"font-weight: 400\"> It granted constitutional status to the National Commission for Backwards Classes (NCBC) and inserted Articles 338B, 342A and 366(26C).<\/span>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Article 342A empowered the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/president-of-india\/\" target=\"_blank\">President of India<\/a><\/strong>, in consultation with the Governor of a State, to specify socially and educationally backward classes for constitutional purposes.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">However, this created uncertainty regarding whether States could continue to prepare and revise their own lists of backward classes.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li style=\"font-weight: 400\"><b>Maratha Reservation Case (2021):<\/b><span style=\"font-weight: 400\"> In Dr Jaishri Laxmanrao Patil v. Its major objectives were:<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To restore the power of States and Union Territories to identify SEBCs.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To clarify that State SEBC lists may differ from the Central List.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To preserve the federal character of India\u2019s reservation framework.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To enable States to account for local social, educational, and economic realities.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To remove the uncertainty created by the Supreme Court\u2019s interpretation of the 102nd Amendment.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">To ensure that State-level welfare measures, educational reservations, and public-employment reservations could continue for eligible backward communities<\/span><\/li>\r\n<\/ul>\r\n<h2><span style=\"font-weight: 400\">105th Constitutional Amendment Act Provisions\u00a0<\/span><\/h2>\r\n<p><span style=\"font-weight: 400\">The 105th Constitutional Amendment Act introduced targeted changes to the Constitution to clarify the respective roles of the Centre and the States in identifying Socially and Educationally Backward Classes.\u00a0<\/span><\/p>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><b>Restored States' Powers: The Amendment<\/b><span style=\"font-weight: 400\"> reaffirmed the power of States and Union Territories to prepare and maintain independent SEBC lists for implementing State reservation policies.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Amended Article 342A:<\/b><span style=\"font-weight: 400\"> The amendment clarified that the Central Government's SEBC list would apply for Central Government purposes.<\/span>\r\n<ul>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">At the same time, every State or Union Territory was empowered to prepare and maintain its own list of socially and educationally backward classes for its own purposes.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Therefore, a community may be included in a State's SEBC\/OBC list even if it is not included in the Central List, subject to the applicable constitutional and legal framework.\u00a0<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li style=\"font-weight: 400\"><b>Clarified the Central List:<\/b> <b>The Act<\/b><span style=\"font-weight: 400\"> specified that the <\/span><b>Central List<\/b><span style=\"font-weight: 400\"> would consist of SEBCs prepared and maintained by the Central Government for Central Government policies and benefits.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Amended Article 338B:<\/b> <b>The Amendment<\/b><span style=\"font-weight: 400\"> inserted a provision in <\/span><b>Article 338B(9)<\/b><span style=\"font-weight: 400\"> stating that States are not required to consult the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/national-commission-for-backward-classes-ncbc\/\" target=\"_blank\">National Commission for Backward Classes (NCBC)<\/a><\/strong> while preparing or revising their own SEBC lists under <\/span><b>Article 342A(3)<\/b><span style=\"font-weight: 400\">.<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Amended Article 366(26C):<\/b><span style=\"font-weight: 400\"> The amendment modified Article 366, which contains constitutional definitions. This restored a power that States had exercised for decades before the 2021 Supreme Court ruling.\u00a0<\/span><\/li>\r\n\t<li style=\"font-weight: 400\"><b>Separate Central and State Lists: <\/b><span style=\"font-weight: 400\">A community may be included in a State SEBC list but may not necessarily appear in the Central List.
