GI tags\u00a0<strong>serve as intellectual property rights<\/strong>\u00a0that identify a product's unique geographical source, providing legal protection and preventing unauthorised use.<\/p>\r\n<p>In India, the\u00a0<strong>Geographical Indications of Goods (Registration and Protection) Act, of 1999<\/strong>\u00a0governs the registration and protection of GIs. These tags play a crucial role in promoting and\u00a0<strong>safeguarding<\/strong>\u00a0the unique products and traditional knowledge of various regions, contributing to rural development, preserving cultural heritage, and enhancing the marketability of Indian products in the global market.<\/p>\r\n<h2>What is GI Tag?<\/h2>\r\n<p>A\u00a0<strong>Geographical Indication (GI tag)\u00a0<\/strong>is a sign used on products with a\u00a0<strong>specific geographical origin,<\/strong>\u00a0possessing unique qualities or reputation due to that origin. It serves as an intellectual property right (IPR), attributing a product\u2019s quality, reputation, or other characteristic to its geographical origin.<\/p>\r\n<ul>\r\n\t<li>GIs are recognized as an aspect of IPRs under the<strong>\u00a0Paris Convention for the Protection of Industrial Property<\/strong>\u00a0and the Trade-Related Aspects of Intellectual Property Rights<strong>\u00a0(TRIPS) Agreement.<\/strong><\/li>\r\n\t<li><strong>Benefits:\u00a0<\/strong>It lets approved users stop others from using the indication if their product doesn't meet the standards. A GI tag confers the following rights to the registered proprietors:\r\n\r\n<ul>\r\n\t<li><strong>Legal protection\u00a0<\/strong>against unauthorised use by others.<\/li>\r\n\t<li><strong>Exclusive right\u00a0<\/strong>to use the GI tag for the specified goods or products.<\/li>\r\n\t<li><strong>Ability to prevent\u00a0<\/strong>misuse, imitation, or misleading representations of the GI tag.<\/li>\r\n\t<li><strong>Legal recourse<\/strong>\u00a0against infringement or unfair competition.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Type of products:\u00a0<\/strong>Geographical indications can be used for a wide range of products, including agricultural products, foodstuffs, wines, spirits, handicrafts, and industrial products.\r\n\r\n<ul>\r\n\t<li>However, such products must possess specific qualities or characteristics attributable to their geographical origin.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Eligibility criteria:\u00a0<\/strong>Any trader\u2019s group, association, or organization can apply for a GI tag. They must demonstrate the product\u2019s uniqueness with historical records and a detailed production process.\r\n\r\n<ul>\r\n\t<li>GI tags aren\u2019t only for popular products; they exist for hundreds of items across states, each recognising a specific region and product.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<div>\u00a0<\/div>\r\n<h3>International Conventions on GI Tags<\/h3>\r\n<p>These international conventions and systems play a crucial role in protecting and promoting products with a GI tag, ensuring they maintain their unique identity and quality.<\/p>\r\n<ul>\r\n\t<li><strong>Paris Convention:<\/strong>\u00a0The Paris Convention for the\u00a0<strong>Protection of Industrial Property\u00a0<\/strong>(1883) provides a multilateral framework for the protection of industrial property rights, including geographical indications.\r\n\r\n<ul>\r\n\t<li>It establishes the principles of national treatment and the right of priority.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Lisbon System:<\/strong>\u00a0The Lisbon Agreement for the<strong>\u00a0Protection of Appellations of Origin and their International Registration\u00a0<\/strong>(1958) establishes an international registration system for appellations of origin, a specific type of GI.\r\n\r\n<ul>\r\n\t<li>It provides a centralised filing procedure and ensures protection for all contracting parties.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Madrid System:\u00a0<\/strong>The Madrid System for the<strong>\u00a0International Registration of Marks<\/strong>, while primarily focused on trademarks, can also be utilised for the protection of geographical indications through the registration of collective or certification marks.<\/li>\r\n<\/ul>\r\n<h2>GI Tag in India<\/h2>\r\n<p>The<strong>\u00a0Geographical Indication Registry,<\/strong>\u00a0a division of the\u00a0<strong>Ministry of Commerce and\u00a0<\/strong>Industry\u2019s Department of Industry Promotion and Internal Trade<strong>\u00a0(DIPIT)<\/strong>, is responsible for issuing GI tags, further safeguarding these unique products and their geographical origins. The GI tag holds\u00a0<strong>significant importance for India<\/strong>, as it:<\/p>\r\n<ul>\r\n\t<li><strong>Promotion and protection<\/strong>: It promotes and safeguards the unique products and traditional knowledge of various regions, contributing to rural development and empowerment.<\/li>\r\n\t<li><strong>Marketability and competitiveness<\/strong>: It enhances the credibility\/marketability and competitiveness of Indian products in the global market.<\/li>\r\n\t<li><strong>Preservation of cultural heritage<\/strong>: It preserves the cultural heritage and traditional practices associated with the production of these products.<\/li>\r\n\t<li><strong>Prevention of misappropriation<\/strong>: It prevents misappropriation and misuse of traditional knowledge by unauthorized parties.<\/li>\r\n\t<li><strong>Sustainable practices and environmental conservation<\/strong>: It encourages sustainable production practices and environmental conservation in the designated regions.<\/li>\r\n<\/ul>\r\n<h3>GI Act of 1999<\/h3>\r\n<p>The\u00a0<strong>Geographical Indications of Goods (Registration and Protection) Act, 1999<\/strong>\u00a0is the main law in India that oversees the registration and protection of geographical indications. The Act\u2019s\u00a0<strong>key provisions include:<\/strong><\/p>\r\n<ul>\r\n\t<li>The establishment of the\u00a0<strong>Geographical Indications Registry<\/strong>, which is responsible for processing and registering GI applications.<\/li>\r\n\t<li>The\u00a0<strong>criteria<\/strong>\u00a0for registering a GI, include the association between the product and its geographical origin, and the reputation or quality attributable to that origin.<\/li>\r\n\t<li>The\u00a0<strong>duration of protection<\/strong>\u00a0is initially 10 years but can be renewed indefinitely.<\/li>\r\n\t<li>Provisions for enforcing GI rights, including civil and criminal\u00a0<strong>penalties for infringement.<\/strong><\/li>\r\n\t<li>Provisions for registering authorised users and associations of producers.<\/li>\r\n<\/ul>\r\n<h3>GI Tag as an IPR<\/h3>\r\n<p>Geographical Indications are recognized as a form of intellectual property rights under the TRIPS Agreement of the World Trade Organization (WTO). As an IPR, GIs:<\/p>\r\n<ul>\r\n\t<li><strong>Protect the collective rights<\/strong>\u00a0of producers and communities associated with a particular product.<\/li>\r\n\t<li><strong>Prevent the misuse<\/strong>\u00a0or misappropriation of a product\u2019s reputation or characteristics by unauthorized parties.<\/li>\r\n\t<li><strong>Contribute to the preservation<\/strong>\u00a0of traditional knowledge and cultural heritage.<\/li>\r\n\t<li><strong>Promote fair trade\u00a0<\/strong>practices and sustainable development in rural communities.<\/li>\r\n<\/ul>\r\n<h2>State Wise GI Tag Products in India<\/h2>\r\n<p>The GI Registry is located in Chennai processes and registers GI Applications. The\u00a0<strong>tag was first given to Darjeeling Tea.<\/strong>\u00a0However, GI tags aren\u2019t only for popular products; they exist for hundreds of items across states, each recognizing a specific region and product.
