

{"id":4065,"date":"2026-03-04T09:29:55","date_gmt":"2026-03-04T03:59:55","guid":{"rendered":"https:\/\/vajiramandravi.com\/upsc-exam\/?p=4065"},"modified":"2026-03-10T13:28:06","modified_gmt":"2026-03-10T07:58:06","slug":"sixth-schedule","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/upsc-exam\/sixth-schedule\/","title":{"rendered":"6th Schedule of Indian Constitution, Provisions, States, Articles"},"content":{"rendered":"<h2><strong>6th Schedule of Indian Constitution Objectives<\/strong><\/h2>\r\n<p>The objectives of the Sixth Schedule of the Indian constitution are:<\/p>\r\n<ul>\r\n\t<li>To provide for the administration of tribal areas in the northeastern states of\u00a0<strong>Assam, Meghalaya, Tripura, and Mizoram.<\/strong><\/li>\r\n\t<li>To protect tribal land and resources and prohibits the transfer of such resources to non-tribal individuals or communities.<\/li>\r\n\t<li>To ensure the tribal communities are not exploited or marginalized by non-tribal populations and that their cultural and social identities are preserved and promoted.<\/li>\r\n<\/ul>\r\n<h2><strong>6th Schedule of Indian Constitution Provisions<\/strong><\/h2>\r\n<p>The significant provisions of the Sixth Schedule are as follows<\/p>\r\n<ul>\r\n\t<li><strong>Article 244(2):\u00a0<\/strong>The provisions of the Sixth Schedule shall apply to the administration of the tribal areas in the States of Assam, Meghalaya, Tripura, and Mizoram.<\/li>\r\n\t<li><strong>Autonomous districts and autonomous regions:<\/strong>\r\n<ul>\r\n\t<li>The tribal areas in the four states of Assam, Meghalaya, Tripura, and Mizoram are to be administered as<strong>\u00a0Autonomous Districts<\/strong>.<\/li>\r\n\t<li>If there are different Scheduled Tribes in an autonomous district, the Governor can divide the district inhabited by them into\u00a0<strong>Autonomous Regions.<\/strong><\/li>\r\n\t<li>The Governor is empowered to organize and reorganize the autonomous districts. He can also increase, decrease the boundaries or alter the name of any autonomous district.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Constitution of District Councils and Regional Councils:<\/strong>\r\n<ul>\r\n\t<li>There shall be a\u00a0<strong>District Council<\/strong>\u00a0for each autonomous district consisting of not more than 30 members, of whom not more than four persons shall be nominated by the Governor, and the rest shall be elected on the basis of<strong>\u00a0adult suffrage<\/strong>.<\/li>\r\n\t<li>There shall be a separate<strong>\u00a0Regional Council<\/strong>\u00a0for each area constituted an autonomous region.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Powers of the District Councils and Regional Councils to make laws:<\/strong>\r\n<ul>\r\n\t<li>The District and Regional councils are empowered to make laws on certain specified matters like lands, management of forest (other than the Reserved Forest), inheritance of property, etc.<\/li>\r\n\t<li>These councils also empowered to make law for the regulations and control of money-lending or trading by any person other than Scheduled Tribe residents in that Scheduled District.<\/li>\r\n\t<li>However, all laws made under this provision require the assent of the Governor of the State.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Administration of justice in autonomous districts and autonomous regions:<\/strong>\r\n<ul>\r\n\t<li>The District and Regional Councils are empowered to constitute<strong>\u00a0Village and District Council Courts<\/strong>\u00a0for the trial of suits and cases where all parties to the dispute belong to Scheduled Tribes within the district.<\/li>\r\n\t<li>The High Courts have jurisdiction over the suits and cases which is specified by the Governor.<\/li>\r\n\t<li>However, the Council Courts are not given the power to decide cases involving offenses punishable by death or imprisonment for five or more years.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li>The District and Regional Councils are empowered to assess and collect land revenue and impose taxes on professions, trades, animals, vehicles, etc. The Councils are given the\u00a0<strong>power to grant licenses or leases for the extraction of minerals<\/strong>\u00a0within their jurisdiction.<\/li>\r\n\t<li>The District Councils and Regional Councils are given the power<strong>\u00a0to establish, construct or manage primary schools,<\/strong>\u00a0dispensaries, markets, cattle ponds, fisheries, roads, road transport and waterways in the districts.<\/li>\r\n\t<li>To autonomous districts and autonomous regions, the acts of Parliament or the state legislature do not apply or apply with specified modifications and exceptions.<\/li>\r\n\t<li>The\u00a0<strong>Governor can appoint a commission to investigate<\/strong>\u00a0and provide a report on any issue pertaining to the management of the autonomous districts or regions.<\/li>\r\n<\/ul>\r\n<h2><strong>6th Schedule of Indian Constitution States<\/strong><\/h2>\r\n<figure>\r\n<table>\r\n<tbody>\r\n<tr>\r\n<td class=\"tb-color\">Assam<\/td>\r\n<td class=\"tb-color\">\r\n<ul>\r\n\t<li>North Cachar Hills District<\/li>\r\n\t<li>The Karbi Anglong District<\/li>\r\n\t<li>The Bodoland Territorial Areas District<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>Meghalaya<\/td>\r\n<td>\r\n<ul>\r\n\t<li>Khasi Hills District<\/li>\r\n\t<li>Jaintia Hills District<\/li>\r\n\t<li>The Garo Hills District<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>Tripura<\/td>\r\n<td>\r\n<ul>\r\n\t<li>Tripura Tribal Areas District<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>\r\n<tr>\r\n<td>Mizoram<\/td>\r\n<td>\r\n<ul>\r\n\t<li>The Chakma District<\/li>\r\n\t<li>The Mara District<\/li>\r\n\t<li>The Lai District<\/li>\r\n<\/ul>\r\n<\/td>\r\n<\/tr>\r\n<\/tbody>\r\n<\/table>\r\n<\/figure>\r\n<h2><strong>What are the issues pertaining to the 6th Schedule?<\/strong><\/h2>\r\n<p>There are several issues pertaining to the Sixth Schedule:<\/p>\r\n<ul>\r\n\t<li><strong>Different tribal populations under a single autonomous council:\u00a0<\/strong>Within a single autonomous council, there are various tribal populations with various cultures and customs.\r\n\r\n<ul>\r\n\t<li>For example, In North Cachar Hills district, which was renamed Dima Hasao, there are 13 tribes; the major tribal groups are Dimasa, Kuki, Zeme, Hmar and Karbi.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Insufficient allocation of funds:<\/strong>\u00a0The Members of Chakma, Lai, and Mara Councils are of the view that the funds provided by the Central Government are insufficient and that funds should be distributed to local councils on the basis of their level of backwardness rather than their population.<\/li>\r\n\t<li><strong>Inadequate devolution of power:<\/strong>\u00a0While the Autonomous district councils(ADCs) have been granted significant powers to make laws, the state governments still have a significant role in the administration of these areas, which limits the effectiveness of the ADCs.<\/li>\r\n\t<li><strong>Inter-tribal conflicts:<\/strong>\u00a0The ADCs are meant to represent the interests of all tribal communities in a district, but sometimes, the political process of electing members to the ADCs can lead to conflicts between different tribal groups.<\/li>\r\n\t<li><strong>Corruption and lack of accountability:\u00a0<\/strong>In the functioning of the ADCs, there have been allegations of corruption and misuse of funds. Hence, There is a lack of transparency and accountability in their functioning.<\/li>\r\n\t<li><strong>Lack of awareness and participation:<\/strong>\u00a0Many tribal communities are not fully aware of the provisions of the Sixth Schedule and their rights under it. This can lead to a lack of participation in the political process and a limited understanding of the benefits of the ADCs.<\/li>\r\n<\/ul>\r\n<p><strong>Recent Demand from Ladakh:\u00a0<\/strong><\/p>\r\n<ul>\r\n\t<li>In the last couple of years,\u00a0<strong>Ladakh<\/strong>\u00a0has been the location of many developmental projects. These include India\u2019s first geothermal power plant and green hydrogen unit. Seven hydropower projects are also proposed to be built on the Indus river and its tributaries.<\/li>\r\n\t<li>These rapid development projects challenge the fragile ecosystem of Ladakh. To protect the fragile ecosystem of Ladakh, Ladakhis have demanded their region\u2019s inclusion in the Sixth Schedule of the Indian Constitution.<\/li>\r\n\t<li>Ladakh also has a<strong>\u00a0tribal population of more than 97 percent<\/strong>, fulfilling the criteria for Sixth Schedule status.<\/li>\r\n<\/ul>\r\n<h2><strong>What steps could be taken for the effective implementation of the 6th Schedule?<\/strong><\/h2>\r\n<ul>\r\n\t<li><strong>Strengthening of Autonomous District Councils:<\/strong>\u00a0The ADCs should be strengthened with adequate resources, administrative and financial powers, and personnel to ensure effective functioning.<\/li>\r\n\t<li><strong>Removing disparity among council:<\/strong>\u00a0It is essential to take effective measures for the elimination of disparity among council, state, and central functions so that the provisions established for the Tribal people in the sixth schedule can be effectively implemented for their better future.<\/li>\r\n\t<li><strong>Inclusion of more areas:<\/strong>\u00a0The scope of the Sixth Schedule should be expanded to include more areas with a substantial tribal population. This would help in protecting the rights and interests of the tribal people and promoting their development.<\/li>\r\n\t<li><strong>Increase autonomy:\u00a0<\/strong>The autonomous district councils (ADCs) established under the Sixth Schedule should be given more powers to manage their affairs independently.
