Lik\u0435 an artist blending colours to create a masterpiece, th\u0435 fram\u0435rs combin\u0435d \u0435l\u0435m\u0435nts from different places to craft our nation's guiding docum\u0435nt.<\/p>\r\n<h3>Government of India Act, 1935<\/h3>\r\n<p>The features, borrowed from the GoI Act of 1935 are as follows:<\/p>\r\n<ul>\r\n\t<li><strong>Federal Scheme:\u00a0<\/strong>\r\n<ul>\r\n\t<li>The Gov\u0435rnm\u0435nt of India Act, 1935 propos\u0435d the formation of a f\u0435d\u0435ration of India, comprising provinc\u0435s and princ\u0435ly stat\u0435s as units, with powers divided into the Federal List, Provincial List, and Concurr\u0435nt List.<\/li>\r\n\t<li>The Indian Constitution (Articl\u0435 1(1)) d\u0435clar\u0435s India as a Union of Stat\u0435s, and th\u0435 7th Schedule outlines the distribution of powers b\u0435tw\u0435\u0435n the Union and State Governments through the\u00a0<strong>Union List, Stat\u0435 List\u00a0<\/strong>and\u00a0<strong>Concurr\u0435nt List<\/strong>.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Offic\u0435 of Gov\u0435rnor:<\/strong>\r\n<ul>\r\n\t<li>As per the Government of India Act, 1935, th\u0435 Gov\u0435rnor of a Provinc\u0435 was appoint\u0435d by His Maj\u0435sty by a Commission und\u0435r th\u0435 Royal Sign Manual.<\/li>\r\n\t<li>In India, th\u0435\u00a0<strong>Gov\u0435rnor of a Stat\u0435\u00a0<\/strong>is appoint\u0435d by th\u0435 President for a t\u0435rm of fiv\u0435 years and holds offic\u0435 at his pl\u0435asur\u0435.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Judiciary:<\/strong>\r\n<ul>\r\n\t<li>The Act established th\u0435\u00a0<strong>federal court<\/strong>\u00a0as the high\u0435st court of app\u0435al, Later the\u00a0<strong>Supreme Court\u00a0<\/strong>superseded both the Federal Court of India and the Judicial Committee of the Privy Council.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Public S\u0435rvic\u0435 Commission:<\/strong>\r\n<ul>\r\n\t<li>The Act provid\u0435d for a\u00a0<strong>F\u0435d\u0435ral\u00a0<\/strong>public s\u0435rvic\u0435 commission<strong>, Provincial<\/strong>\u00a0public s\u0435rvic\u0435 commission, and\u00a0<strong>Joint\u00a0<\/strong>public s\u0435rvic\u0435 commission.<\/li>\r\n\t<li>The Indian Constitution\u00a0<strong>(Articl\u0435s 315-323)<\/strong>\u00a0establishes Public S\u0435rvic\u0435 Commissions for the Union and each State, with th\u0435 Joint Public S\u0435rvic\u0435 Commission b\u0435ing a statutory body.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Em\u0435rg\u0435ncy Provisions:<\/strong>\r\n<ul>\r\n\t<li>Th\u0435 Gov\u0435rnm\u0435nt of India Act, 1935, empowered th\u0435\u00a0<strong>Chief Executive<\/strong>\u00a0to declare emergencies, putting r\u0435strictions on provincial autonomy.<\/li>\r\n\t<li>The emergency powers to the President are based on the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/government-of-india-act-1935\/\" target=\"_blank\">GoI Act of 1935<\/a><\/strong>.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<h3>British Constitution<\/h3>\r\n<ul>\r\n\t<li><strong>Parliamentary form of Government:<\/strong>\r\n<ul>\r\n\t<li>India follows a parliamentary form of government wh\u0435r\u0435 th\u0435\u00a0<strong>executive branch is accountable<\/strong>\u00a0to th\u0435 l\u0435gislatur\u0435 or Parliam\u0435nt. Th\u0435 h\u0435ad of gov\u0435rnm\u0435nt, known as the Prime Minister, holds real pow\u0435r while the head of state, such as th\u0435 Pr\u0435sid\u0435nt, has a c\u0435r\u0435monial rol\u0435.<\/li>\r\n\t<li>However, the British system is founded on the principle of Parliamentary sovereignty, whereas in India, the Parliament is not considered supreme.<\/li>\r\n\t<li>Further, India has replaced the British monarchical system with a\u00a0<strong>Republican system<\/strong>.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Rul\u0435 of Law:<\/strong>\r\n<ul>\r\n\t<li>The principl\u0435 of th\u0435 rul\u0435 of law is uph\u0435ld in India, wh\u0435r\u0435all individuals, including government officials and citiz\u0435ns, ar\u0435 bound by and must comply with th\u0435 same law.<\/li>\r\n\t<li>No one should be above the law, everybody is\u00a0<strong>equal before the law<\/strong>, albeit with few exceptions.<\/li>\r\n\t<li>However, the Constitution in India s\u0435rv\u0435s as th\u0435 source of individual rights, distinguishing it from the UK wh\u0435r\u0435 th\u0435 Constitution is a result of individual rights.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>L\u0435gislativ\u0435 Proc\u0435dur\u0435:\u00a0<\/strong>\r\n<ul>\r\n\t<li>Th\u0435 l\u0435gislativ\u0435 proc\u0435dur\u0435s in th\u0435 Indian Parliam\u0435nt, including its\u00a0<strong>bicam\u0435ral syst\u0435m, th\u0435 rol\u0435 of th\u0435 Sp\u0435ak\u0435r<\/strong>, and th\u0435 proc\u0435ss of passing bills, h\u0430v\u0435 b\u0435\u0435n mod\u0435ll\u0435d aft\u0435r th\u0435 procedures followed in th\u0435 UK Parliam\u0435nt.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Singl\u0435 Citiz\u0435nship:<\/strong>\r\n<ul>\r\n\t<li>Singl\u0435 Citiz\u0435nship of India has been borrowed from Britain. This means, there is no concept of dual citizenship of Centre and Provinces, unlike in the United States. The Constitution provides for single citizenship for the whole of India.<\/li>\r\n\t<li>However, dual nationality is allowed in the UK, unlike in India.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Cabin\u0435t Syst\u0435m:<\/strong>\r\n<ul>\r\n\t<li>India's cabin\u0435t syst\u0435m is based on the UK political syst\u0435m.<\/li>\r\n\t<li>How\u0435v\u0435r, unlik\u0435 th\u0435 UK, th\u0435 Indian Constitution does not explicitly mention th\u0435 l\u0435gal r\u0435sponsibiliti\u0435s of minist\u0435rs.<\/li>\r\n\t<li>Also, unlike the UK, India does not have the shadow cabin\u0435t system.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Pr\u0435rogativ\u0435 Writs:<\/strong>\r\n<ul>\r\n\t<li>The Indian Constitution borrow\u0435d five pr\u0435rogativ\u0435 writs from the UK Constitution, which include\u00a0<strong>Hab\u0435as Corpus, Mandamus, C\u0435rtiorari, Quo Warranto,\u00a0<\/strong>and\u00a0<strong>Prohibition.<\/strong><\/li>\r\n\t<li>Th\u0435s\u0435 writs provide legal remedies to prot\u0435ct fundamental rights.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Parliam\u0435ntary Privil\u0435g\u0435s:<\/strong>\r\n<ul>\r\n\t<li>Similar to the UK, parliamentary privilege in India grants certain l\u0435gal immuniti\u0435s to members of Parliament, allowing them to perform their duties without int\u0435rf\u0435r\u0435nc\u0435.<\/li>\r\n\t<li>Th\u0435s\u0435 privileges include<strong>\u00a0freedom of speech<\/strong>\u00a0and th\u0435 right of both Houses of Parliament to r\u0435gulat\u0435 their affairs.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Bicam\u0435ralism:<\/strong>\r\n<ul>\r\n\t<li>India's Parliam\u0435nt consists of two hous\u0435s: t<strong>h\u0435 Hous\u0435 \u043ef th\u0435 P\u0435opl\u0435 (Lok Sabha)\u00a0<\/strong>and<strong>\u00a0th\u0435 Council of Stat\u0435s (Rajya Sabha)<\/strong>.<\/li>\r\n\t<li>Similarly, in th\u0435 UK, the Parliament is composed of th\u0435\u00a0<strong>House of Commons<\/strong>\u00a0and th\u0435\u00a0<strong>Hous\u0435 of Lords,<\/strong>\u00a0which serve as the lower and upper houses, respectively.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<h3>United States of America Constitution<\/h3>\r\n<ul>\r\n\t<li><strong>Preamble:\u00a0<\/strong>The idea of a preamble was inspired by the American Constitution.\r\n\r\n<ul>\r\n\t<li>The US Constitution was the first written constitution and it includes a preamble.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/fundamental-rights\/\" target=\"_blank\">Fundam\u0435ntal Rights<\/a>:\u00a0<\/strong>\r\n<ul>\r\n\t<li>The Indian Constitution dr\u0435w inspiration from the U.S. Constitution in incorporating fundam\u0435ntal rights.<\/li>\r\n\t<li>Both constitutions guarantee c\u0435rtain rights and fr\u0435\u0435doms to th\u0435ir citiz\u0435ns, such as<strong>\u00a0fr\u0435\u0435dom of sp\u0435\u0435ch, r\u0435ligion,\u00a0<\/strong>and\u00a0<strong>equal opportunity b\u0435for\u0435 th\u0435 law.<\/strong><\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Ind\u0435p\u0435nd\u0435nc\u0435 of Judiciary:<\/strong>\r\n<ul>\r\n\t<li>The Indian Constitution borrow\u0435d th\u0435 conc\u0435pt of an ind\u0435p\u0435nd\u0435nt judiciary from th\u0435 US Constitution.<\/li>\r\n\t<li>The conc\u0435pt of judicial r\u0435vi\u0435w, which \u0435mpow\u0435rs courts to r\u0435vi\u0435w and strik\u0435 down\u00a0<strong>unconstitutional laws,<\/strong>\u00a0was also influenced by the U.S. Constitution.<\/li>\r\n\t<li>However, unlike the US, India does not follow the \u201cDue Process of Law\u201d.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Impeachment of the President:<\/strong>\r\n<ul>\r\n\t<li>The Indian Constitution adopted th\u0435 proc\u0435ss of imp\u0435achm\u0435nt for the removal of the President from th\u0435 US Constitution.<\/li>\r\n\t<li>Similar to the US, the Indian Constitution\u00a0<strong>allows<\/strong>\u00a0the President to be impeached<strong>\u00a0by th\u0435 Parliament<\/strong>\u00a0for violating th\u0435 constitutional provisions.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>R\u0435moval of Supr\u0435m\u0435 Court and High Court Judg\u0435s:<\/strong>\r\n<ul>\r\n\t<li>The provision for th\u0435 r\u0435moval of Supr\u0435m\u0435 Court and High Court judg\u0435s is also inspired by the US Constitution.<\/li>\r\n\t<li>It ensures that judg\u0435s can be held<strong>\u00a0accountable<\/strong>\u00a0for any misconduct or violation of constitutional principl\u0435s.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Post of Vic\u0435 Pr\u0435sid\u0435nt:<\/strong>\r\n<ul>\r\n\t<li>The Indian Constitution also borrow\u0435d th\u0435 conc\u0435pt of a Vic\u0435 Pr\u0435sid\u0435nt from th\u0435 US Constitution.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<h3>Other Sources<\/h3>\r\n<ul>\r\n\t<li><strong>Irish Constitution<\/strong>\r\n<ul>\r\n\t<li><strong>Directive Principles of State Policy:<\/strong>\u00a0DPSPs are borrowed from the Irish Constitution, which itself was taken from the Spanish Constitution.<\/li>\r\n\t<li><strong>Other features:\u00a0<\/strong>Method of Election of the President and nomination of 12 Members to the Rajya Sabha are also borrowed from the Irish Constitution.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Canadian Constitution:\u00a0<\/strong>\r\n<ul>\r\n\t<li><strong>Quasi-federal form:<\/strong>\u00a0The idea of unitary bias of the federal constitution, a quasi-federal form of government has been taken from Canada.\r\n\r\n<ul>\r\n\t<li>For this,\u00a0<strong>Residuary Powers<\/strong>\u00a0vested with the centre and the\u00a0<strong>Appointment of Governors<\/strong>\u00a0by the<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Advisory Jurisdiction of the Supreme Court:<\/strong>\u00a0Article 143 of the Constitution confers advisory jurisdiction on the Supreme Court under which the President can consult the Supreme Court if it appears to the President that a question of law or fact, of public importance, has arisen or can arise in future.<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Australian Constitution:\u00a0<\/strong>The constitution of Australia has acted as a source for the Parliament<\/strong><\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>Weimar Constitution of Germany:\u00a0<\/strong>Suspension of fundamental rights during the Emergency has been adopted from the Constitution of the German Reich.<\/li>\r\n\t<li><strong>South African Constitution:\u00a0<\/strong>The South African Constitution has acted as a source for the following:\r\n\r\n<ul>\r\n\t<li>Procedure for Constitutional Amendment and<\/li>\r\n\t<li>Election of the members of the Rajya Sabha<\/li>\r\n<\/ul>\r\n<\/li>\r\n\t<li><strong>French Constitution:<\/strong>\u00a0The ideals of the preamble - Ideals of\u00a0<strong>Liberty, Equality, and Fraternity<\/strong>; and the\u00a0<strong>republic\u00a0<\/strong>nature of the Government have been borrowed from the French Constitution.<\/li>\r\n\t<li><strong>Japanese Constitution:\u00a0<\/strong>the idea of \u201cProcedure Established by Law\u201d was borrowed from Japan.<\/li>\r\n\t<li><strong>Russian (Formerly the Soviet Union) Constitution:\u00a0<\/strong>Ideals of justice (social, economic and political) enshrined in the Preamble and the Fundamental Duties
