Initially constituted as a\u00a0<strong>statutory body<\/strong>\u00a0in 1993, NCBC was later granted\u00a0<strong>constitutional status<\/strong>\u00a0in 2018 through the\u00a0<strong>102nd Constitutional Amendment Act<\/strong>.<\/p>\r\n<p>NCBC plays a crucial role in ensuring equitable opportunities for backward classes in employment, education, and other socio-economic spheres. By monitoring the implementation of policies and making recommendations, NCBC acts as a\u00a0<strong>watchdog for the rights of SEBCs<\/strong>, aiming for their overall upliftment.<\/p>\r\n<h2>NCBC Establishment<\/h2>\r\n<p>In the\u00a0<strong>1992 Mandal<\/strong>\u00a0case judgment, the Supreme Court directed the central government to establish a permanent statutory body to address complaints regarding the under-inclusion, over-inclusion, or exclusion of any class of citizens from the backward classes list. As a result, the\u00a0<strong>National Commission for Backward Classes\u00a0<\/strong>(NCBC) was formed in 1993.<\/p>\r\n<ul>\r\n\t<li>The\u00a0<strong>102nd Constitutional Amendment Act of 2018<\/strong>\u00a0later elevated the NCBC to constitutional status by introducing\u00a0<strong>Article 338B<\/strong>\u00a0into the Constitution.<\/li>\r\n\t<li>This change transformed the NCBC from a statutory to a\u00a0<strong>constitutional body<\/strong>, with an expanded mandate to more effectively protect the interests of socially and educationally backward classes.<\/li>\r\n<\/ul>\r\n<h2>NCBC Composition<\/h2>\r\n<p>Under Article\u00a0<strong>338B<\/strong>, the NCBC comprises a Chairperson, a Vice-Chairperson, and three additional members. They serve a term of 3 years from the date they assume office. Their appointment is made by the\u00a0<strong>Preside<\/strong><\/p>\r\n<p><strong>nt<\/strong>\u00a0through an official warrant under his hand and seal. The terms of service and tenure for these officials are determined by rules set by the President. The Commission holds the authority to establish its own procedural guidelines.<\/p>\r\n<h2>NCBC Functions<\/h2>\r\n<p>The NCBC is tasked with safeguarding the rights of socially and educationally backward classes by monitoring legal protections and recommending improvements. It also plays an\u00a0<strong>advisory role\u00a0<\/strong>in the socioeconomic development of these communities. The key functions of NCBC are as follows:<\/p>\r\n<ul>\r\n\t<li>Investigate and monitor\u00a0<strong>constitutional and legal safeguards<\/strong>\u00a0for SEBCs and assess their effectiveness.<\/li>\r\n\t<li>Inquires into\u00a0<strong>complaints\u00a0<\/strong>regarding the deprivation of SEBC rights and safeguards.<\/li>\r\n\t<li>Advises on and evaluates the socioeconomic development of SEBCs at the Union and state levels.<\/li>\r\n\t<li>Submits\u00a0<strong>annual and additional reports\u00a0<\/strong>to the President on the implementation of SEBC protections.<\/li>\r\n\t<li>Recommends measures for better implementation of safeguards and welfare policies for SEBCs.<\/li>\r\n\t<li>Performs other functions related to the protection and advancement of SEBCs as directed by the President.<\/li>\r\n<\/ul>\r\n<h2>NCBC Reports<\/h2>\r\n<p>The Commission submits an annual report to the\u00a0<strong>President\u00a0<\/strong>and can also provide additional reports whenever necessary. These reports are then presented by the President\u00a0<strong>to\u00a0<\/strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/functions-of-parliament\/\" target=\"_blank\"><strong>Parliament<\/strong><\/a>, accompanied by a memorandum detailing the actions taken on the Commission\u2019s recommendations, including reasons for any recommendations not accepted.<\/p>\r\n<ul>\r\n\t<li>If a report concerns a state government, the President forwards it to the respective state.<\/li>\r\n\t<li>The state government is responsible for presenting the report to its legislature, along with a memorandum outlining actions taken and justifications for any unaccepted recommendations.<\/li>\r\n<\/ul>\r\n<h2>NCBC Powers<\/h2>\r\n<p>The NCBC holds significant powers, including the authority to\u00a0<strong>regulate its procedures<\/strong>. When investigating matters or addressing complaints, the Commission functions with the powers of a<strong>\u00a0civil court<\/strong>, allowing it to take various legal actions during inquiries. Additionally, both the central and state governments must consult the NCBC on major policy issues that affect socially and educationally backward classes. The key powers of NCBC are as follows:<\/p>\r\n<ul>\r\n\t<li>Summon and enforce the attendance of any individual from across India for examination under oath.<\/li>\r\n\t<li>Request the discovery and production of documents.<\/li>\r\n\t<li>Receive evidence through affidavits.<\/li>\r\n\t<li>Requisition of public records from courts or other offices.<\/li>\r\n\t<li>Issue summons for the examination
