Ministry of Petroleum and Natural Gas released the Draft Petroleum Amendment Bill 2026 on 30 September 2026 for public and stakeholder consultation.

The proposed Bill seeks to amend the Petroleum Act, 1934, particularly its provisions related to offences, penalties, licensing violations and legal procedures.

The government has proposed replacing the existing broad penalty framework with a graded system. Under the proposed framework, routine breaches of licence conditions would be dealt with through civil penalties, while serious offences such as unlicensed petroleum activities, fraud, pilferage, damage to petroleum facilities and threats to public safety would continue to attract criminal penalties.

Draft Petroleum Amendment Bill 2026 proposes a graded penalty framework under the Petroleum Act, 1934, separating routine licence violations from serious offences involving safety, infrastructure and unlicensed petroleum activities.

  • Decriminalisation of Minor Violations: Routine breaches of licence terms and conditions would move from criminal liability to civil adjudication. An authorised adjudicating officer would handle such cases following the principles of natural justice.
  • Civil Penalties for Licence Breaches: A penalty of up to ₹2.5 crore for the first breach and up to ₹5 crore for subsequent breaches is proposed. The authority may also direct corrective action or recommend suspension or revocation of the licence.
  • Penalties for Unlicensed Activities: Carrying out petroleum activities without the required licence may attract imprisonment up to 3 years or a fine up to ₹25 crore, or both. Continuing violations may attract an additional fine of up to ₹10 lakh per day.
  • Fraudulent Licensing: Obtaining a petroleum licence through fraud, dishonesty, misrepresentation or impersonation would be treated as a specific criminal offence, with imprisonment of up to 5 years, or fine, or both.
  • Infrastructure Damage, Pilferage and Safety Risks: Serious offences involving pilferage, damage to petroleum facilities or threats to public safety may attract up to 5 years’ imprisonment or ₹15 crore fine for a first offence and up to 7 years’ imprisonment or ₹25 crore fine for subsequent offences.
  • Protection of Critical Petroleum Infrastructure: The Central Government may designate certain petroleum facilities or areas as critical petroleum infrastructure. Damage to such infrastructure may attract up to 10 years’ imprisonment and a fine of up to ₹25 crore, subject to the conditions specified in the draft.
  • Stronger Enforcement and Legal Procedures: The Bill proposes specific provisions for obstruction of authorised officers, failure to report petroleum accidents, wider confiscation powers and alignment of criminal proceedings with the Bharatiya Nagarik Suraksha Sanhita, 2023.
