Political Parties in India

Political parties are an essential part of India’s parliamentary democracy. They organise public interests, contest elections, form governments, provide political alternatives and connect citizens with the government. Although the Constitution does not expressly define political parties, their functioning is governed through constitutional provisions, laws and regulations of the Election Commission of India (ECI).

Political Parties in India Constitutional and Legal Basis

The constitutional and legal framework for political parties is spread across different provisions rather than being contained in a single law.

  • Article 19(1)(c) provides citizens with the fundamental right to form associations or unions, which provides the constitutional basis for forming political parties.
  • Article 324 gives the ECI superintendence, direction and control over elections.
  • Section 29A of the Representation of the People Act, 1951 provides for registration of political parties with the ECI.
  • The Election Symbols (Reservation and Allotment) Order, 1968 lays down the framework for recognition of National and State parties and allotment of election symbols.
  • The 52nd Constitutional Amendment Act, 1985 inserted the Tenth Schedule, bringing political-party defections within the constitutional framework.

Thus, political parties function through a combination of constitutional rights, parliamentary legislation and ECI regulations.

Registration of Political Parties

The first step for an organisation seeking formal political-party status is registration with the Election Commission of India under Section 29A of the Representation of the People Act, 1951.

An association must apply to the ECI within 30 days of its formation and affirm faith in the Constitution, including socialism, secularism and democracy, while also upholding the sovereignty, unity and integrity of India.

It is important to distinguish registration from recognition. Registration makes an organisation a registered political party, but it does not automatically make it a National or State party or give it a permanently reserved election symbol.

Recognition of Political Parties

The Election Commission broadly classifies registered political parties as National Parties, State Parties and Registered Unrecognised Political Parties (RUPPs) under the Election Symbols (Reservation and Allotment) Order, 1968.

National Parties

A registered party is recognised as a National Party if it fulfils any one of the following conditions:

  • It secures at least 6% of valid votes in four or more States in a Lok Sabha or Assembly election and wins at least 4 Lok Sabha seats.
  • It wins at least 2% of the total Lok Sabha seats, with its members elected from at least three States.
  • It is recognised as a State Party in at least four States.

The current six National Parties are Bharatiya Janata Party (BJP), Indian National Congress (INC), Bahujan Samaj Party (BSP), Communist Party of India (Marxist) [CPI(M)], Aam Aadmi Party (AAP) and National People's Party (NPP).

Recognition, however, is not necessarily permanent and depends on continued electoral performance. Under the ECI's 2016 review policy, the status of a recognised party is reviewed after two consecutive elections, giving it an additional election to regain the required level of performance. The ECI may also suspend or withdraw recognition under Paragraph 16A of the Election Symbols Order, 1968, including for failure to comply with the Model Code of Conduct or lawful directions of the Commission.

State Parties

A party can be recognised as a State Party if it fulfils any one of the prescribed conditions in that State, including:

  • Securing at least 6% of valid votes in an Assembly election and winning at least 2 Assembly seats.
  • Securing at least 6% of valid votes in a Lok Sabha election from the State and winning at least 1 Lok Sabha seat.
  • Winning at least 3% of Assembly seats or 3 seats, whichever is higher.
  • Winning at least 1 Lok Sabha seat for every 25 Lok Sabha seats allotted to the State.
  • Securing at least 8% of total valid votes in the State in a Lok Sabha or Assembly election.

Registered Unrecognised Political Parties

Registered Unrecognised Political Parties (RUPPs) are parties registered with the ECI but not recognised as either National or State parties.

  • India has over 2,700 RUPPs, forming the overwhelming majority of registered political parties. 
  • They can contest elections but do not enjoy the same symbol-related privileges as recognised parties. 

The ECI has also taken measures to identify inactive and non-compliant parties.

Role of Political Parties

Once registered and recognised, political parties perform several functions that keep representative democracy functioning.

  • Contest elections by selecting and fielding candidates.
  • Aggregate interests by bringing together different social and economic demands.
  • Form governments when they obtain the required legislative support.
  • Provide opposition and hold the government accountable.
  • Formulate policies through manifestos and political programmes.

Evolution of the Party System in India

The nature of political competition in India has changed significantly since independence.

  • 1950s-1960s (One-party dominance): The Congress dominated national and State politics. Political scientist Rajni Kothari described this phase as the "Congress System."
  • 1967 onwards (Rise of opposition and regional parties): The 1967 elections weakened Congress's dominance in several States and strengthened opposition and regional parties.
  • Late 1980s-2014 (Coalition era): National politics increasingly saw coalition governments such as the National Front, United Front, National Democratic Alliance (NDA) and United Progressive Alliance (UPA).
  • 2014-2019 (Single-party majority): The BJP secured a majority on its own in the Lok Sabha in both 2014 and 2019.
  • 2024 onwards (Coalition dependence): The BJP-led NDA formed the government after the 2024 Lok Sabha elections, with the BJP depending on its allies for a parliamentary majority.

Thus, India's party system has evolved from one-party dominance to a competitive multi-party system, with regional parties becoming an important part of national politics.

Political Funding

Political parties need financial resources for elections, organisation and political activities. This makes political funding an important issue of transparency and accountability.

Major sources of funding include membership contributions, individual donations and corporate donations.

The Companies Act, 2013 originally restricted corporate political contributions to 7.5% of the average net profits of the preceding three financial years. This ceiling was removed in 2017, allowing companies to make political donations without the earlier statutory limit.

Registered political parties can also receive certain income-tax exemptions, subject to prescribed conditions relating to accounts, records and donations.

Electoral Bonds and Political Funding

The Electoral Bonds Scheme, 2018 allowed individuals and companies to make political contributions through authorised banking channels while keeping the donor's identity confidential from the public.

In Association for Democratic Reforms v. Union of India (2024), the Supreme Court struck down the Electoral Bonds Scheme, holding that non-disclosure of political funding information violated citizens' right to information under Article 19(1)(a).

The judgment reinforced the importance of transparency and accountability in political funding.

Despite their central role in democracy, political parties face several institutional and democratic challenges.

  • Dinesh Goswami Committee (1990): Recommended limited state funding in kind, such as fuel, loudspeakers and copies of electoral rolls.
  • Vohra Committee (1993): Examined the nexus between criminals, politicians and bureaucracy.
  • Indrajit Gupta Committee (1998): Supported partial state funding for recognised National and State parties, preferably in kind rather than cash.

  • Kihoto Hollohan v. Zachillhu (1992): The Supreme Court upheld the broad constitutional validity of the Tenth Schedule, while holding that decisions of the Speaker or Chairman under the Anti-Defection Law are subject to judicial review.
  • Union of India v. Association for Democratic Reforms (2002): The Supreme Court recognised voters' right to information about election candidates, including information relating to their criminal antecedents, assets and educational qualifications.

The Education-Employment Disconnect

  • Only 8.25% of graduates are employed in jobs aligned with their qualifications, according to data cited from the Economic Survey 2024-25.
  • Graduate unemployment stands at around 13%, while unemployment among graduate women is 20.4%, compared with the national unemployment rate of 3.2%.
  • Of 3.4 crore undergraduate students, 1.13 crore are enrolled in B.A., while combined enrolment in B.A., B.Sc. and B.Com exceeds 2 crore.
  • The State of Working India report also highlights persistent educated unemployment.
    • For example, unemployment among graduates below 25 rose from 35% in 1983 to 39% in 2023, while that among graduates aged 25–29 increased from 12% to 20%.
  • Thus, the challenge is not merely a shortage of jobs but a mismatch between qualifications, skills and labour-market demand.
  • This reflects the problem of credential inflation—possession of degrees has expanded faster than the availability of suitably skilled employment.

NEET and the Skilling Information Gap

  • NITI Aayog identified 8.7 crore people aged 15–29 as NEET (Not in Education, Employment or Training), accounting for 11% of the population outside the labour force.
  • However, the Aayog subsequently clarified that the NEET category in its report refers to people not seeking employment and should therefore not be equated with unemployment or added to the unemployment rate.
  • Lack of awareness is a major barrier to skilling. 
    • For example, around 47% of women, 43% of youth, 36% of higher-education students, 52% of formal workers and 55% of informal workers, do not pursue skills.
    • This is due to inadequate information about suitable programmes among the leading reasons.

Social Stigma Around Vocational Education

  • Technical and vocational pathways such as ITIs, diplomas and vocational training continue to be viewed as “second-tier” options by many families and students.
  • Career choices are frequently influenced by -
    • Examination scores and family preferences;
    • Perceived social status of conventional degrees;
    • Cost of acquiring additional skills;
    • Inadequate knowledge of career alternatives; and
    • Absence of visible success stories from vocational pathways.
  • This creates a degree-centric education culture, even when alternative pathways may offer better employment prospects.

Skilling Has Significant Wage Returns

  • The report cites BCG data showing that a generic undergraduate without additional skilling earns an average starting salary of about ₹22,000 per month, compared with ₹29,000 for a similarly qualified graduate with skilling.
  • At the reported growth rate, the initial ₹7,000 monthly difference could translate into an estimated ₹9.7 lakh cumulative income gap over 10 years.
  • For women, barriers are compounded by concerns regarding safety, trust, social permission, time constraints and uncertain employment outcomes.

Structural Weaknesses in Existing Skilling Architecture

  • Existing programmes often measure success through enrolment and completion, rather than placement; wage progression; career advancement; or long-term employability.
  • Delivery is also often inflexible and insufficiently differentiated for diverse learner groups.
  • Awareness of schemes such as PMKVY, DDU-GKY and PM Internship Scheme remains inadequate, particularly among those who could benefit most.
  • India needs to move from an input-based skilling model to an outcome-based model, where funding and institutional performance are linked to employment, earnings and career progression.

NITI Aayog’s Policy Roadmap

    • Shift towards industry-linked education: Generic degrees should be redesigned into applied specialisations, such as B.A. Hospitality; B.Sc. Applied Technology; and B.Com. Analytics.
    • Expand work-based learning: Scale up Apprenticeship Embedded Degree Programmes (AEDP) and Work-Integrated Degree Programmes (WIDP) to integrate classroom learning with practical experience.
  • Target sunrise and transition sectors:
    • Skilling should prioritise high-growth sectors such as green industries, electric vehicles and emerging technologies. 
    • At the same time, workers affected by technological disruption or structural decline in sectors such as traditional automotive manufacturing and mining require reskilling and transitional income support.
